By the present Mark Ciangura (ID 26570M) of Saint Peter, Tas-Salvatur limits of Rabat, makes referece to the land that he owns in Tas-Salib, limits of Rabat (Malta), that is found in the area known as Il-Ħawlija and Ġebel Għomor, which land is property of the family Spiteri Maempel.

The said land is adjacent to the premises known as Green Acres, Il-Ħawlija, Tas-Salib, limits of Rabat (Malta), which is owned by you or any one of you.

The access to the land which the applicant enjoys is through a passage over your property (or of one of you), which servitude of right of way was created through a public deed dated 3rd January, 1966.

It results that this passage was removed by you (or by one of you) or by persons authorised by you with the result that the applicant is precluded from acceding to the land he possesses from the said passage.

It has to be said that the passage formed by you or any one of you or persons authorised by you is blocked and so the applicant not even pass from this passage as it is subject to an enforcement notice issued by the Planning Authority or its predecessors.

Thus, by means of this present the interpellant is soliciting you so that within one week from the date of this judicial letter you restore the passage which originally existed over your property (or of one of you) through which the applicant used to access the land he possesses and which servitude of passage was constituted by means of a public deed of the 3rd January, 1966.

In default of your complying with this solicitation, the applicant will commence further proceedings against you without any further notice.

With costs and reserving the right for any further action by the interpellant according to law.

Whereas Victor Xerri pro et noe et has, by an application filed on the 6th October, 2017 (Application Number 73/2017JVC) applied for the appointment of a curator to Fortunato Bartolo for the opening of the secret will of Fortunato Bartolo, for a declaration that the public will of Fortunato Bartolo be accessible, and that the applicant himself be put into provisional possession of the property of the mentioned Fortunato Bartolo, son of the late Giovanni Bartolo and Mary née Vella, who was born in Xagħra, Gozo, on the first (1st) March, one thousand eight hundred ninety- four (1894), who is alleged to have been absent from the Maltese Islands for several decades, and this is at least from the time of the First World War (1914-1918) when he left Malta without any news of him having been received.

Whosoever has any news of the existence of the said Fortunato Bartolo, is required to communicate it to the undersigned Registrar of the Court Of Magistrates (Gozo) (Voluntary Jurisdiction Section), for the information of the said Court, within one month from the day of the publication of this present edict in the Government Gazette.
