By means of a public deed in the records of Notary Dr Robert John Muscat dated the 21st of April, 2016, the applicant company acquired the properties described in the Schedule of Deposit and Concurrent Redemption of Ground Rent i.e. (1) a street level garage, official property number 101, Triq ir-Rebħa, Gżira; (2) the premises with official property numbers 103 and 105, Triq ir-Rebħa, Gżira, and (3) the tenement with official property number 107, Triq ir-Rebħa, Gżira;

The aforementioned properties are subject to an annual and perpetual sub-ground rent, amount specified in the same Schedule of Deposit and Concurrent Redemption of Ground Rent;

The heirs of the sub-grantees are unknown;

The applicant company would like to avail itself of the faculty contemplated in Article 1501 of the Civil Code (Cap. 16 of the Laws of Malta) and redeem this same sub-ground rent in terms of the cited law by depositing the sum of €1980.00 which represents the value of the said sub-ground rent capitalized at 5% as well as the amount of €495.00 representing the sub-ground rent of the last five years in order to be freely withdrawn by the deputy curators appointed to represent the unknown heirs of Carmelo sive Charles Ellul Sullivan, after the due receipt is left according to law.

It is being notified that by a decree dated 16th November, 2017, given by the Court of Magistrates (Malta) as a Court of Criminal Inquiry (Magistrate Dr Ian Farrugia, LLD) Compilation number 511/2017 in the case:

Robert Attila Majlat, 39 years, un-employed, son of Domonkos, born in Miskolci, Hungary on the 28th July, 1978, residing at 37, Flat 8, Triq Efesu, St Paul’s Bay, Malta, and holder of Hungarian identity card bearing number 199275LA;

Ordered the attachment in the hands of third parties in general all monies and other movable property due or pertaining or belonging to Robert Attila Majlat and Robert Attilane Majlat and prohibits the said accused from transferring, pledging, hypothecating or otherwise disposing of any movable or immovable property and this according Section 23A of the Criminal Code, Cap. 9 of the Laws of Malta.
 
The Court Authorised the accused Robert Attila Majlat and Robert Attilane Majlat to receive each the amount authorized by law which is thirteen thousand, nine hundred and seventy six euro and twenty-four cents (€13,976.24) on an annual basis provided that every financial entity is ordered to present a note by which it informs the Court in which account or from which account these monies are taken or the accused themselves may indicate to the Court from which account they are perceiving the money indicated.

Any person who acts in contravention of the court order mentioned in Section 23A referred to above shall be guilty of an offence and shall on conviction be liable to a fine (multa) not exceeding eleven thousand and six hundred and forty-six euro and eighty-seven cents (€11,646.87), or to imprisonment for a period not exceeding twelve months, or to both such fine and imprisonment.

Any transfer or other disposal of any immovable property made in contravention of the said Court order shall be null and without effect at law.

By means of Application, filed, in the First Hall Civil Court, in the records of the Banns in the names Karkanja Developments Limited vs Deputy Curators Schedule Number 649/2017, in the names Karkanja Developments Limited (C 34155) vs Deputy Curators to represent the unknown heirs of the successors in title of Margherita Aquilina, the applicant Karkanja Developments Limited(C 34155) respectfully pleaded,

That the applicant company filed an application on the 18th April, 2017, whereby she asked that there be appointed deputy curators to represent the unknown heirs of Margherita Aquilina, for the relative directum dominium in the records of the Schedule 649/2017;
That the above request was made in terms of Article 931 sub-section 3 of Cap. 12 of the Laws of Malta;

That due to an oversight there were appointed deputy curators on the basis of banns issued by this Honourable Court instead on the basis of a publication in the Government Gazette and in two local newspapers;

That for this purpose it is necessary that the decree above mentioned be revoked so that the procedure on the basis of publication be made;

Thus, whilst bringing the above to the formal notice of this Honourable Court the applicant humbly prays in order that Deputy Curators be appointed so that there be revoked the decree of this Honourable Court, of the19 th April, 2017 instead there be appointed deputy curators to represent the interests of the unknown heirs of Margherita Aquilina, for the directum dominium in terms of Article 931 of sub-section 3 of Cap. 12 of the Laws of Malta by making the publication in the Government Gazette and in two local newspapers.
