Whereas in the said deed, the premises aforementioned is indicated as being transferred as freehold and unencumbered, subsequently it results from the deed in the records of Notary Francesco Refalo dated the 1st October of the year nineteen forty-five (1945) that the same premises is subject to ’one pound sterling’, [equivalent to two Euros and thirty three euro cents (€2.33)] annual and perpetual ground rent.

Whereas notwithstanding that the said deed indicates that a Pietro Cassar imposed this ground rent, applicant did not manage to trace who at present are the persons entitled to receive this ground rent, and namely who are the heirs and/or the successors in title of the said Pietro Cassar.

Thus the applicants in order to exonerate themselves from any responsibility and redeem this ground rent and thus they are humbly calling upon this Honourable Court and under its authority are depositing the amount of forty-six euro and sixty euro cents (€46.60) as schedule of redemption of ground rent due as above explained, so that said amount may be freely withdrawn by respondent, after due receipt is tendered in its regard.
