1. That this is an appeal from a final judgement given by the Rent Regulation Board, on the 30 th March 2017, in the names premised;

2. That by means of the original application of the present cause, the applicant propio et nomine after having premised;

i.That he grants on lease to the respondent the premises 36, Flat 3, St. Francis Street, Qormi, towards the rent of € 116.47 yearly payable every three months in advance the first instalment on the 1st March 2007;

ii. That the respondent caused considerable damage in the premises in such a manner, that damage is being caused to the underlying premises, property of the applicant.

Asked that he be authorised by this Board in order not to renew the lease and take back possession of the premises Flat 3,St. Francis Street, Qormi.

3)That in virtue of her reply the respondent Mariella Debono pleaded that the said Board is to reject the demands for eviction because according to her it is not true that she caused considerable damage in the premises leased, but the damage was caused because of the manner in which the same building was constructed.

4) That in virtue of its final judgement of the 30th March 2017, the Rent Regulation Board for the reasons therein premised rejected the applicant’s demands with costs against him.

5) That the grievances of the interpellant are clear and manifest and consist in the following;

The First Grievance,

6) That the first grievance of the interpellant is that the Rent RegulationBoard did a very bad evaluation of the first ground in the demand for eviction.

7) That as results from the minutes of the on site access of the 28th November 2013, the then Magistrate today Hon. Mr. Justice Giovanni Grixti noted that ‘the roof appears not to be taken care of as should have been.

8) That furthermore, the then presiding Magistrate, during the same access of the 28th November 2013, as regards the kitchen of the premises merit of this cause had noted that ‘ the roof of this kitchen to be made of concrete and is damaged in various parts.

9)That apart from that above careful examination of the testimony of Emmanuel Azzopardi, given on the 3rd October 2007 and that of Anthony Emanuel Muscat, given on the 21st October 2009, the damages merit of this cause were systematically pointed out.

15) That from the proof brought by the respondent it appears clear that the respondent is trying to put the blame on the bad construction as the Techincal and Judicial members of the Board Architect David Pace and Joseph A. Briffa, did in their report.

16) With all respect, even if there was defective work and construction it results most clearly that the premises leased was delivered to the respondent in good state for the use it was intended –and this is not contradicted.

17) Also, even if there were defective work and construction there was still the obligation of the respondent to hold the premises leased to her merit of this cause in a good state of maintenance and in any case, it was still her duty that if she thought that there were repairs which had to be made and were the duty of the owner according to law she calls upon them to do them, she failed to do so.
18) That thus keeping in view these facts, the Board had to reach the conclusion that there was no problem when the respondent entered the lease de quo, on the 1st March 1997.

19) That this being stated, the loudest proof of lack of maintenance on the part of the respondent of thepremises leased to her resulted during the access which took place on the 28th November 2013.

23)That thus keeping in view the reasons above brought forward the Board had to authorise the applicants to immediately take back the premises merit of the present cause, 36, Flat 3, St. Francis Street, Qormi.

The Second Grievance.

24) That the interpellants also feel aggrieved because the Board as presided focussed only on the damages which relate to the roof of the underlying garage and decided the cause on the basis of the wrong finding that the respondent did not cause damage in this roof.

26) That it results most clearly from the records that the premises was delivered to the respondent in good condition and fit for habitation.

29) That with all respect the Board was mistaken when it only focussed on the alleged defects in the construction of the block of buildings which the premises merit of this cause forms part.

31)That furthermore it does not result that the respondent made a request to the interpellants so that they carry out repairs which according to law are to be done by the landlord.........omissis........ and for these reasons also the interpellant humbly submits that the Board was mistaken when in its judgement it decided that the respondent appellant did not cause damage in the premises.

The Third Grievance.

32) That the interpellants also feel aggrieved because the Board had keeping in view all the relevant facts of the cause which result from the process, not to give determining weight to the report of the techincal members of the Board.

35) That thus in the humble opinion of the interpellant the Board had to authorise them to take back possession of the premises 36, Flat 3, St. Francis Street, Qormi and thus had to order the eviction of the said Mariella Debono from the same premises and for these purposes had to impose a short and peremptory period.

Thus the present appellant whilst referring to the proof produced and all the relevant records of the proceedings and reserving to bring all the other proof and make the submissions permitted by law, respectfully prays this Honourable Court to revoke the judgement of the the Rent Regulation Board of the 30th March 2017, in the cause in the names premised and instead provide by upholding the applicant’s demands in their entirety.

With costs of both instances against the respondent defendant and saving any action due to the interpellant pro et noe.
