ORDERED the attachment in the hands of third parties in general all monies and other movable property due or pertaining or belonging to GEORGE DEGIORGIO, ALFRED DEGIORGIO AND VINCENT MUSCAT and prohibits the said accused from transferring, pledging, hypothecating or otherwise disposing of any movable or immovable property and this according to Section 23A of the Criminal Code, Chapter 9 of the Laws of Malta.

The Court AUTHORISED the accused George Degiorgio, Alfred Degiorgio and Vincent Muscat to receive each the amount authorized by law which is thirteen thousand, nine hundred and seventy six Euro and twenty-four cents (€13,976.24) on an annual basis provided that every financial entity is ordered to present a note by which it informs the Court in which account or from which account these monies are taken or the accused themselves may indicate to the Court from which account they are perceiving the money indicated.

Any person who acts in contravention of the court order mentioned in Section 23A referred to above shall be guilty of an offence and shall on conviction be liable to a fine (multa) not exceeding eleven thousand and six hundred and forty-six euro and eighty-seven cents (11,646.87), or to imprisonment for a period not exceeding twelve months, or to both such fine and imprisonment.

Any transfer or other disposal of any immovable property made in contravention of the said Court order shall be null and without effect at law.

By means of a decree given, by the Civil Court ( Family Section) on the 16th November, 2017, in the records of the Sworn Application in the names Schembri Sharon vs Brugaletta Mario, Application number 45/17 AL, the following publication was ordered for the purpose of service of the respondent Mario Brugaletta, in terms of Article 187(3) et. sequitur of Cap. 12.

By means of a Sworn Application, filed, in the Civil Court ( Family Section) in the names Sharon Schembri vs Mario Brugaletta, on the 23 rd February 2017, the applicant Sharon Schembri (ID 338778M) respectfully pleaded;

1. That the applicant and the respondent were in a relationship, from which relationship two children were born, who are minors.

2. That the respondent is absent and has been absent for these last nine years and does not contribute any maintenance and there is no form of communication.

4. That the applicant  needs to be in a position to take important decisions which she needs to take were the children are concerned.

Thus the respondent is to state why this Honourable Court  should not;

i Declare that the care and custody of the minor children lies with the applicant and grant in a definitive manner the care and custody to the applicant.

ii. Declare and liquidate the adequate amount of maintenance which should be payable by the respondent to the applicant for the children’s needs and provide as regards the demands regarding the  modality of payment and the other demands regarding maintenance.

With costs, against the respondent summoned so that a reference to their evidence be made.
