By means of a decree given by this Court, on the 29th November, 2017, following a request of HSBC Bank Malta plc, it was ordered that deputy curators be chosen to represent the unknown owners of the directus dominius in the records of the Schedule in the names HSBC Bank Malta plc vs Deputy Curators, and in the other relative and subsequent acts.

By means of a Schedule of Deposit presented in the First Hall Civil Court, in the names HSBC Bank Malta plc (C 3177) vs Adv. and PL Deputy Curators to represent the unknown owners of the directus dominius of the emphyteutical concession regarding the property known as Kargo House,in Triq San Ġwakkin, Mrieħel, in the limits of Birkirkara, on the 28th November, 2017, the interpellant company HSBC Bank Malta plc (C 3177) respectfully pleaded,

That the interpellant is the owner of the premises or rather workshop or rather showroom with the name Kargo House, in Triq San Ġwakkin, Mrieħel, in the limits of Birkirkara, which premises was acquired animo compensandi by the interpellant through the judicial sale held under the authority of the Court on the 19th April, 2011;

That this property is subject to the annual and perpetual groundrent of €46.59;

That although the Bank is conscious of the fact that the groundrent was once payable to a certain Vera Ellul Bonnici, it is not in a position despite some attempts to ascertain the identity or full identity of the owners of the directus dominius burdening the same premises.

Thus, the interpellant is calling upon this Honourable Court and under the Authority of the same depositing the sum of (€279.54) representing five payments of groundrent and €46.59, representing payment of lawdemium which together represent payment in full settlement for any claim in regard to arrears of groundrent so that this sum be freely withdrawn by who has the right to them according to law after the due reciept is left.

You are therefore ordered to affix an official copy of this bann at the entrance of this Superior Court and to summon whosoever wishes to act as curator to appear before this Reġistry within six days and by means of a minute to submit a declaration that he wishes so to act.

You are also ordered to inform each one that if he fails to make this declaration within the stipulate tiome, this Court will proceed to the selection of Curators of Office.

And after so acting or if you should encounter any difficulty in the execution of this bann, you are to inform forthwith this Court.

That the children of the aforementioned spouses Farrugia were four i.e. the applicant, his brother Alfred (represented by the applicant) and two other brothers Joseph and Paul now deceased;

That upon the death of their mother Salvina, owner of the property de quo, the abovementioned property devolved as described in the abovementioned Application;

That the said property was held in common for more than three years (as elaborated upon with precision in the said Application);

That on the 9 day of August, 2017, the applicant in his own name and on behalf of his brother Alfred Farrugia, entered into a promise of sale agreement with a prospective buyer of the property de quo, Moyra Naudi, with the selling price of €60,564 and subject to further conditions;

That the abovementioned property was held in common for more than three years as afore said, that none of the owners instituted action to partition the property de quo, and that the applicant and his brother Alfred (represented by the applicant) own an undivided third respectively and thus together they constitute the largest number of co-owners in terms of the size of the value of the share to each owner;

That none of the respondents would be seriously compromised with the sale proposed to the approval of the court.

Therefore, the applicant Filippo Farrugia pro et noe asks that this Honourable Court orders the sale of the abovementioned property in favour of Moyra Naudi according to the price and terms and other conditions agreed in the promise of sale dated the 9th day of August, 2017 drawn up by Notary Roberta Bisazza, and consequently uphold the other demands listed in the aforementioned Application.
