FOUNDATION FOR EDUCATIONAL SERVICES

 

Call for Quotations - Provision of Legal Services

Ref: FES/HO/2018/05

 

The Foundation for Educational Services (FES), is requesting quotations for the provision of Legal Services particularly in connection with various administrative and employment and industrial relations matters. The services will also cover other general legal advice.

 

Interested applicants are invited to submit their quotation for the provision of these services. The term ‘Proposer’ shall be construed to mean the person/s or organisation submitting proposal to the FES.

 

1. Background

 

1.1 The FES is a public entity within the Ministry for Education and Employment. It facilitates the link between formal and informal teaching on a national level by providing a range of innovative educational initiatives.

 

2.  The Deliverables

 

2.1 The Appointee would be responsible for the provision of legal advice on various administrative and employment and industrial relations matters.

 

2.2 In order to carry out the above tasks, the Appointee will have to liaise with the Ministry for Education and Employment and other stakeholders depending on the case. 

 

3. Eligibility Criteria

 

3.1 The Appointee must be either

 

3.1.1 A person/s

 

a) in possession of a Doctorate of Law (LL.D) or comparable qualification at MQF level 7;

 

 

b) in possession of a warrant to exercise the profession of Advocate or Notary Public in Malta.

 

Qualifications at a level higher than that specified above will be accepted for eligibility purposes. Previous experience in human resources and employment and industrial relations matters would be given preference.

 

Or

 

3.1.2 An organisation which can appoint person/s as representatives and for which it would be directly responsible, meeting the above requirements listed in 3.1.1.

 

4. Contents and Submission of the Quotation

 

4.1 The documentation to be submitted by the Proposer:

 

4.1.1 Person/s

 

a) detailed CV (with copies of certifications outlined in 3.1.1);

 

b) evidence of previous experience if applicable.

 

4.1.2 Organisation

 

a) general description of the services offered;

 

b) credentials;

 

c) outline of the organigram;

 

d) detailed CV of the person that will be appointed as the representative of the organisation, including copies of certification outlined in 3.1.1.

 

4.1.3 Quotation is to be submitted based on a rate per hour basis. Rate is to be inclusive of VAT.

 

4.2 The quotation submitted is to be signed by the authorised signatory of the Proposer.

4.3 All information requested in this document must be provided. If any section is not deemed to be applicable, the Proposer shall indicate it accordingly. This without prejudice to the right of FES to disqualify any person/s or organisation that do not provide the complete information as requested.

 

 

4.4 The proposal must be drawn up in English.

 

4.5 The quotation must be submitted by not later than Friday, 23rd February, 2018. FES may invite Proposers to supplement or clarify documents they submit.

 

4.6 Late submissions will not be considered.

 

 

4.7 Proposers are to submit two (2) copies of their proposals which will be sealed in an envelope and sent to at the following address:

6. General Information

6.3 Acceptance/non-acceptance of proposals will be advised as soon as possible.

 

6.4 FES is not bound to accept the service offered by any Proposer and reserves the right to reject any or all proposals, even the cheaper option.

 

6.5 Contract will be awarded and shall be valid for a period of one (1) year or by when the threshold of €5000 excl. VAT is reached.

 

6.6 Any communication requesting further information on the required services to be provided or on the proposal itself shall be made in writing via email no later than three days before the closing date stipulated above and forwarded to (amanda.mizzi@gov.mt).

 

6.7 FES shall answer all queries in writing.

Call for the Provision of Site Supervision Services

 

The Foundation for Tomorrow’s Schools (FTS) is responsible for the execution of the ongoing multi-million euro programme for the construction, refurbishment and maintenance of state schools in Malta and Gozo.

 

To comprehensively manage the construction process and ensure that works match agreed plans, the FTS invites applications from project management companies and/or architectural services firms for the provision of site supervision services.

 

Services include protection of the interests of the FTS and its clients by means of:

 

general direction, coordination and oversight of on-site work processes and procedures;

issue of instructions to contractors’ key site personnel;

attendance to compliance with contract conditions including cost control and time schedules;

advance planning;

preparation of all site-based documentation; and

 

oversight of contractors during testing and commissioning until handover.

 

Project management companies and/or architectural services firms are required to offer the services of suitably qualified personnel familiar with construction management software applications against payment of an hourly rate by the FTS.

GOZO CHANNEL GROUP

 

The Gozo Channel Group (‘Gozo Channel’) wishes to participate in the competitive tender process issued by the Maltese Ministry for Transport, Infrastructure and Capital Projects for a Public Service Concession Contract for the Provision of Passenger and Vehicle Ferry Services Between Malta and Gozo (the ‘Tender’).

 

The Tender was published on 26th January, 2018, on the Maltese Government’s e-Tenders website and the procurement documentation is available on (https://www.etenders.gov.mt/epps/cft/prepareViewCfTWS.do?resourceId=4209736)

 

In accordance with the Tender, the awardee of the Tender is required to provide conventional ferry services between Ċirkewwa (Malta) and Mġarr (Gozo), fast ferry services between Valletta (Malta) and Mġarr (Gozo) as public service obligations and is also requested to provide Concessionaire Additional Services (as defined in the Tender) with the fast ferry/ies between municipalities in Malta (including between municipalities in Malta and/or Gozo, or municipalities in Gozo and Malta but excluding and points of call within the Grand Harbour)

 

Gozo Channel is the incumbent economic operator for the provision of conventional ferry services, and it therefore has the necessary experience, expertise and resources to provide those services.

 

Gozo Channel is looking for a partner with whom to submit the bid for the Tender (the ‘Partner’) which has the necessary experience, expertise or resources to provide fast ferry services (and the Concessionaire Additional Services).  Any interested party is expected to prove to Gozo Channel that it is in a position to meet the applicable specifications, requirements and criteria applicable to the fast ferry services as required by the Tender.

 

The Partner is expected to commit exclusively to Gozo Channel’s bid and it may not submit its own bid, participate as a member in a third party joint venture, consortium or other economic association, or accept to be named as a sub-contractor in a third party’s bid. Gozo Channel will be the lead member of any commercial arrangement reached with the Partner on submitting the bid.

 

Any interested parties who would be open to form an exclusive commercial arrangement with Gozo Channel for the submission of the bid for the Tender are requested to express their interest by sending an email to (eoisubmission@gozochannel.com) by not later than 5.00 p.m. CET of the 23rd February, 2018.  Interested parties are to provide details of:

 

The vessel/s which will be made available for the provision of fast ferry services pursuant to the Tender together with a valid commercial vessel operating license (CVOL) and commercial vessel certificate (CVC) in accordance with Commercial Vessels Regulations (Subsidiary Legislation 499.23); and

Confirmation that (each of) the vessel/s proposed specifically comply with each and every one of the minimum specifications listed in Annex 2 Document B of the Tender. The interested party is required to specifically confirm and, where necessary, provide a detailed explanation and any other relevant  information on the manner that each and every one of the  21 minimum specifications listed in Annex 2 Document B shall be satisfied.

 

Proposals on the Concessionaire Additional Services to be offered in accordance with Clause 2.6 and Annex 1A of the Tender.

 

The type/s of commercial arrangement/s which the interested party would be willing to participate in. After a past preliminary market study, Gozo Channel is looking favourably at a time charter arrangement with the prospective partner, and therefore, interested parties are invited to submit a specific proposal on that prospect along with any alternative commercial arrangements.
