ARB/C004/2020 – NEW FREEZING ORDER

 

IT IS BEING NOTIFIED that by a decree dated 26th March, 2020, given by the Court of Magistrates (Malta) as a Court of Criminal Inquiry – (Magistrate Dr Claire L. Stafrace Zammit LLD). Compilation Number 137/2020 in the case:

Versus

 

KURT MANUEL PACE, barber and pastizzar, 30 years, son of the late Carmel and Anna Manicolo, born in Tal-Pietà, Malta on the 13th January, 1990, residing at Rudolph Mansions, Flat 9, Triq Rodolfu, Tas-Sliema and/or Allamanda, Flat 4, Triq Bella Vista, San Ġwann and holder of Maltese Identity Card bearing number 65190M.  

 

ORDERED the attachment in the hands of third parties in general of all moneys and other movable or immovable property due to or pertaining or belonging to KURT MANUEL PACE and prohibits the said accused from transferring, pledging, hypothecating or otherwise disposing of any movable or immovable property, and this according to 22A of the Dangerous Drugs Ordinance, Chapter 101 of the Laws of Malta and Section 23A of the Criminal Code, Chapter 9 of the Laws of Malta.

 

The Court AUTHORISED the said accused to receive the amount authorised by law that does not exceed thirteen thousand, nine hundred and seventy-six euro and twenty-four cents (€13,976.24) per year, after the accused indicates with a note from where they are perceiving this money.

 

Any person who acts in contravention of the court order mentioned in Section 22A and Section 23A referred to above shall be guilty of an offence and shall on conviction be liable to a fine (multa) not exceeding eleven thousand and six hundred and forty-six euro and eighty-seven cents (€11,646.87), or to imprisonment for a period not exceeding twelve months, or to both such fine and imprisonment.

 

Any transfer or other disposal of any property made in contravention of the said Court order shall be null and without effect at law.

By means of a decree given by this Court on the 10th March, 2020,  following a request of Baron Contracts Limited it was ordered that deputy curators be chosen to represent David Christopher Jackson in the records of the Sworn Application 210/2020TA and in the records of the garnishee order number 341/2020, in the names Baron Contracts Limited vs Deputy Curators and in the  other relative and subsequent acts.

 

By means of a Sworn Application filed in the First Hall Civil Court in the names Baron Contracts Limited (C 14934) vs deputy curators to represent David Christopher Jackson (ID 73484A) absent from these Islands, on the 5th March, 2020, the applicant company Baron Contracts Limited (C 14934) requested with respect and Francis Xavier Tabone (ID 177468M) as director of the applicant company for and on behalf of the same confirmed on oath:

 

The applicant company is the creditor of the respondent in the total amount of €148,086.80 out of which the amount of €57,000.00 represents the balance of the price due for contract of works done by the applicant company as requested by the respondent, in terms of a contract of works signed on the 10th November, 2015 (attached as BCL1) after the deduction of the penalties for the delay according to the same contract and the amount of €91,086.80 represents the balance of the price due for additional works not included in the contract abovementioned, done by the applicant company on request of the respondent, as results from the invoices here attached (Doc. BCL 2).

 

That the same amounts are certain, liquid and due debt and in the opinion of the applicant company there are all the elements requested by articles 167 till 170 of Chapter 12 of the Laws of Malta, so that the case is decided summarily without proceeding to trial, and in the opinion of the same applicant company the respondent does not have any defences to bring forward against the request for the payment of the said amount.

 

So the applicant was solicited several times to pay the said amount but he remained in default of payment.

 

So this case had to be filed.

 

Thus for the reasons abovementioned the applicant company requests with respect this Honourable Court subject to all the opportune declarations and provisions:

 

1. To proceed with hearing these proceedings summarily without proceeding to trial according to articles 167 till 170 of Chapter 12 of the Laws of Malta;

 

2. To declare the applicant company as the creditor of the respondent in the total amount of €148,086.80 out of which the amount of €57,000.00 represents the balance for the price due for contract of works done by the applicant company as requested by the respondent, in terms of a contract of works signed on the 10th November, 2015 (attached as BCL1) after the deduction of the penalties for the delay according to the same contract and the sum of €91,086.80 represents the balance of the price due for additional works not included in the contract abovementioned, done by the applicant company on request of the respondent, as results from the invoices here attached (Doc. BCL 2);

 

With costs besides the legal interest from the 18th October, 2018, till the date of effective payment against the respondent who is from now summoned so that a reference to his oath be made.

 

By means of a Garnishee Order filed on 5th March, 2020, in the First Hall of the Civil Court, in the names Baron Contracts Limited (C 14934) vs deputy curators to represent the unknown heirs of David Christopher Jackson (ID 73484A) absent from these Islands, the applicant Baron Contracts Limited (C 14934) respectfully requested and Francis Xavier Tabone (ID 177468M) director of the applicant company and on behalf of the same confirmed on oath:

 

That this Court orders the issue of a garnishee order to be executed on the garnishee or garnishees as hereinafter mentioned against the debtor for the debt herein mentioned and for the costs of this procedure, as security for the debt hereinafter indicated.

That by virtue of a deed in the records of Notary Giuseppi Cauchi of the eleventh (11th) October, one thousand nine hundred and fifty-eight (1958), Angelo Said was assigned a divided portion of the land known as 'Ta' Fejn tas-Sajsu' measuring circa seven kejliet equivalent to one hundred and forty point fifty-one square metres (140.51sq.m.) bounded South with a passage, West with property of Ġanni Said and North with property of Paul Said or their successors in title of more accurate boundaries, on which portion of land was constructed the tenement numbered eleven (11) in an unnamed and unnumbered alley that abuts unto Ramla Road, Nadur, Gozo, as better shown outlined in red on the plan herewith annexed as Document 'A';

 

That on the said deed this portion of land is declared to be subject to the annual and perpetual ground rent of three pence equivalent to one cent of the Maltese Lira (Lm0.01c) and three euro cents (€0.03c), but there is no declaration as to whom this ground rent is payable;

 

That the applicants are the legitimate heirs of the said Angelo Said, being his children and the children of his deceased children;

That the applicants want to make use of the faculty given to them by Article 1501 of the Civil Code and redeem this ground rent, which capitalised by five percent (5%) amounts to sixty euro cents (€0.60);

 

That the applicants have no idea of the identity of the person or entity who might have the right to receive this ground rent;

 

That in order to liberate themselves from all responsibility, the applicants also want to deposit under the authority of this Court all the arrears of ground rent due as from the date of acquisition of this land by Angelo Said and therefore from the year one thousand nine hundred and fifty-eight (1958) which amount to one euro and eighty-six cents (€1.86).

 

Therefore in order to liberate themselves from all responsibility they are delivering to this Honourable Court and depositing under its authority the global sum of two euro and forty-six cents (€2.46) due as above explained, which sum can be withdrawn by whom has the right to it, after leaving the relevant receipt.

 

You, the executive officer of the Court of Magistrates (Gozo) are therefore ordered to affix an official copy of these banns at the entrance of this Court, and to summon whosoever would like to act as curator to appear in this Registry within six (6) days, and by means of a minute to submit a declaration that they would like to so act.

Whereas by a decree from the Court of Magistrates (Gozo), dated 2nd March, 2020, in the records of the judicial letter number 121/2020 in the names, “HSBC Bank Malta plc (C 3177) versus deputy curators appointed to represent the absent Oystein Dahl (Norwegian Passport 93-J0209390) and Anne Line Dahl (Norwegian Passport 31371357)" and this in the records of the judicial letter filed on the 27th February, 2020, in the Court of Magistrates (Gozo), as well as the other related and subsequent acts. Brings to your formal attention the fact that on the 18th February, 2020, you were in arrears over payments in connection with a loan conceded to you by means of a deed in the records of Notary Maria Vella Magro of the 7th February, 2003, in the amount of eleven thousand three hundred and fifteen euro and twenty-two cents (€11,315.22) and therefore the company calls on you to settle this sum within two days. Also, the company informs you that this sum of arrears will increase by seven hundred seventy-two euro and thirty-nine cents (€772.39) per month after this date.

 

Brings to your formal attention the fact that on the 18th February, 2020, you were in arrears over payments in connection with a loan conceded to you by means of a deed in the records of Notary Paul George Pisani of the 8th July, 2011, in the amount of three thousand two hundred fifty-five euro and forty-eight cents (€3,255.48) and therefore the company calls on you to settle this sum within two days. Also, the company informs you that this sum of arrears will increase by two hundred fifty-six euro and fifty-three cents (€256.53) per month after this date.

 

 

You are advised that in default of settling arrears within fifteen days from the date of notification of this letter, the whole balance of the loan will become immediately due, including legal interest of 8% per annum until effective payment.

 

In order to avoid unnecessary Court expenses, if the payment as indicated is not possible and you require more time to affect payment in monthly instalments, you can admit the debt you owe to the bank by means of a notarial deed. In this case, you are requested to contact the bank and engage a notary within fifteen days.

 

This letter serves also to interrupt prescription, and therefore is requested by law in terms of article 2128 of the Civil Code (Chapter 16 of the Laws of Malta).

 

In default, court action will be taken against you without other advance warning.
