The respondent was solicited several times during the years to pay the rent but he remained in default (vide copies of the judicial letters attached and marked as Doc. B);

 

That also the respondent never worked the fields and this as seen clearly from the photos marked as Doc C and from the photos taken from the Geoportal of the site of the Planning Authority marked as Doc. D).

 

Thus, the applicant request with respect that this Board:

 

1. Authorises the applicants to resume possession the same fields, including the farmhouse by ordering the eviction of the same respondent from the fields, including the farmhouse abovementioned, and this within a short and peremptory time that is fixed by this Board; and

CLAUDE ANN SANT FOURNIER, self-employed, 41 years, daughter of John Zammit and the late Anna Zammit née Galea, born in St. Julian's, Malta on the 19th June, 1980, residing at 5, St. Joseph, Triq Blanche Huber, Sliema and holder of Maltese Identity Card bearing number 350180M.

 

ORDERED the attachment in the hands of third parties in general all moneys and other movable property due or pertaining or belonging to PILATUS BANK PLC and prohibits the accused from transferring, pledging, hypothecating or otherwise disposing of any movable or immovable property, in terms of Article 5 of the Prevention of Money Laundering Act, Chapter 373 of the Laws of Malta, and Article 23A of the Criminal Code, Chapter 9 of the Laws of Malta.

 

ORDERED the temporary attachment in the hands of third parties in general all moneys and other movable property due or pertaining or belonging to CLAUDE ANN SANT FOURNIER and prohibits the accused from transferring, pledging, hypothecating or otherwise disposing of any movable or immovable property, in terms of Article 5 of the Prevention of Money Laundering Act, Chapter 373 of the Laws of Malta, and Article 23A of the Criminal Code, Chapter 9 of the Laws of Malta.

 

The Court AUTHORIZED the said accused to receive the amount of thirteen thousand, nine hundred and seventy-six Euro and twenty-four cents (€13,976.24) per year, after the accused indicates with a note from where she is perceiving this money.

 

Any person who acts in contravention of the court order as mentioned in Article 5, and Article 23A referred to above shall be guilty of an offence and shall on conviction be liable to a fine (multa) not exceeding eleven thousand and six hundred and forty-six Euro and eighty-seven cents (€11,646.87), or to imprisonment for a period not exceeding twelve months, or to both such fine and imprisonment.

 

Any transfer or other disposal of any property made in contravention of the said Court order shall be null and without effect at law.

That by means of a contract in the records of Notary Giuseppe Zammit, dated 24th September 1898 (copy attached and marked as Doc C) the said Elvira Azzopardi granted by way of perpetual sub-emphyteusis to Dr Enrico Mifsud, a portion of land marked with number 1 on the plan attached to the same contract, which portion of land forms part of a larger portion of land above mentioned, for the sub-groundrent of six pounds five shillings (£6.50 per annum, with the right to be redeemed at the rate of 3%.

 

That by means of a contract in the records of Notary Salvatore Borġ Olivier, dated 13th February 1925 (a copy attached and marked as Doc D), the said Dr Enrico Mifsud, together with his wife Elisa, granted a dowry in favour of their daughter Maria Fortunata Mifsud, consisting of the premises with number 29A and 28 in Triq il-Wied, Birkirara, together with the mezzanine that forms part of the same building which has number 2 in Triq Azzopardi, Birkirkara and that is corner with Triq il-Wied, Birkirkara, as subject to the aforesaid annual and perpetual sub groundrent of £6.50 per annum.

 

By means of a secret will dated 4th February 1970 (a copy attached and marked as Doc E) the said Maria Fortunata Pace nèe Mifsud, left by title of legacy to Leone Gulia and his wife Elena Gulia, the premises in question, that is the shop number 46 and the overlying house with number 47 (previously 29A and 28 respectively) in Triq il-Wied, Birkirkara, together with the mezzanine with number 2 in Triq Azzopardi, Birkirkara.

 

That by means of a contract in the records of Notary Dr Paul Pullicino dated 16th February 1977 (copy attached and marked as Doc F) the said Leone and Elena Gulia were placed in possession of the premises in question that is the shop number 46 and theoverlying house number 47, in Triq il-Wied, Birkirkara together with the mezzanine numbered 2 in Triq Azzopardi, Birkirkara.

 

That by means of a will in the records of Notary Dr Paul Pullicino, dated 3rd August 1977 (copy attached and marked as Doc G) the said Leone Giulia, instituted and nominated as his unversal heirs his wife the said Elena Giulia, Leone Giulia died on the 9th February 1980;

 

That by a will in the records of Notary Oscar Azzopardi dated 20th August 1957 (copy attached and marked as Doc H, Elena Gulia nominated and instituted as sole universal heir her husband Leone Gulia. Elena Gulia died as widow and childless on the 8th March 1993 (copy of the death certificate here attached and marked as Doc I).

 

That the succession of Elena Gulia was opened in favour of Beatrice Wagner who is the sister and sole heir of the said Elena Gulia by means of a decree of the Court of Voluntary Jurisdiction numbered 449/2004 dated 13th May 2004 (a copy attached and marked as Doc J) .

 

That by means of causa mortis declaration made in the records of Notary Dr Elizabeth Sciriha dated 26th June 2004 (copy attached and marked as Doc K), Beatrice Wagner declared that she inherited form her sister Elena Gulia, inter alia, the premises in question that is the premises number 46, Triq il-Wied, Birkirkara, the premises number 47, in Triq il-Wied, Birkirkara, and the premises numbered 2 in Triq Azzopardi, Birkirkara.

 

That the said Beatrice Wagner died a widow, on the 13th June 2005 and according to the European of Succession certificate (attached and marked as Doc L) the applicant Ursula Barbara Glenk is the sole heir of Beatrice Wagner;

 

The applicant wishes to avail herself of the option given to her according to law and this in terms of article 1501 of Chapter 16 of the Laws of Malta (Civil Code) and redeem this annual and perpetual groundrent of Lm6.50 today equivalent to €15.14 and this in terms of the contract in the records of Notary Giuseppe Zammit dated 24th September 1898 (Doc C) with the rate of 3%.

 

That the amount of €15.14 capitalised at the rate of 3% amounts to €504.67;

 

That apart for the amount above mentioned the applicant is also depositing the groundrent arrears for the last five years that amount to €75.70.
