By means of a decree of the 5th October, 2021, of the Rent Regulation Board, in the records of the Application in the names Charles Cremona et vs Joseph Mallia et, Application number 229/2021MV, the following publication was ordered for the purpose of effecting service on the respondents Joseph Mallia and Mary Carmen Mallia in terms of Article 187(3) et sequitur of the Code of Organisation and Civil Procedure (Cap. 12)

 

By means of an application in the names Charles Cremona (ID 554258M), Paul Cremona (ID 176361M), Mary Anne Bellizzi née Cremona (ID 085160M) and her husband John Bellizzi (ID 0276554M) and Joseph Cremona (ID 213255M) vs Joseph Mallia (ID 220242M) and Mary Carmen Mallia (ID 857645M) and Housing Authority filed in the Rent Regulation Board, on the 23rd June, 2021, the applicants Charles Cremona (ID 554258M) et requested this Honourable Board why it should not:

 

1. Declare and decide that the respondents Joseph Mallia (ID 220242M) and Mary Carmen Mallia (ID 857645M) are the lessees of the applicants of the premises 116, Josephine, Our Lady of Sorrows Street, Ħamrun, and qualifies as the lessees of a residential house on the basis of this definition, in terms of Article 2 of the Reletting of Urban Property (Regulation) Ordinance as amended by Act XXIV of 2021 and thus she in entitled to continue to occupy the residential house in terms of Article 2 of the Reletting of Urban Property (Regulation) Ordinance as amended by Act XXIV of 2021;

 

2. Order that the means test of the respondents Joseph Mallia (ID 220242M) and Mary Carmen Mallia (ID 857645M) be carried out which shall be based on the means test set out in the Rules of the Continuation Tenancies (Means Testing Criteria) issued under Article 1622A of the Civil Code and any regulations that replace them, which test shall be based on the income of the lessee between 1st January and 31st December, 2020, and on the capital of the lessee on the 31st December, 2020;

 

3. Declare and decide that in accordance with Act No XXIV of 2021, the rent shall be revised to an amount not exceeding 2% of the free and unencumbered open market value of the premises 116, Josephine, Our Lady of Sorrows Street, Ħamrun and to establish new conditions regarding the lease;

 

4. Order that in the event that the respondents Joseph Mallia (ID 220242M) and Mary Carmen Mallia (ID 857645M) does not meet the criteria of income and capital of the means test, the eviction of the same respondents from the said premises within a short and peremptory time established by this Board by not later than two (2) years from the 1st June, 2021.

 

With costs against the respondent who is from now summoned so that a reference to her oath be made and without prejudice to any other action that may eventually be filed.

By means of a decree of the 15th October, 2021, of the Rent Regulation Board, in the records of the Application in the names Alexia Ellul vs Alfred Mercieca et, Application number 418/2021NB, the following publication was ordered for the purpose of effecting service on the respondents Alfred Mercieca and Jane Mercieca in terms of Article 187(3) et sequitur of the Code of Organisation and Civil Procedure (Cap. 12)

 

By means of an application in the names Alexia Ellul (ID 64402L) vs Alfred Mercieca (KI 121252M), Jane Mercieca (ID 83746M) and Housing Authority filed in the Rent Regulation Board, on the 30th July, 2021, the applicant Alexia Ellul (ID 64402L) et requested this Honourable Board to find why it should not:

 

1. Declare and decide that the respondents Alfred Mercieca (ID 121252M) and Jane Mercieca (ID 83746M) are the lessees of the premises 40/1, Triq l-Imħażen, Floriana, and qualify as the lessees of a residential house on the basis of this definition, in terms of Article 2 of the Reletting of Urban Property (Regulation) Ordinance as amended by Act XXIV of 2021 and thus they are entitled to continue to occupy the residential house in terms of Article 2 of the Reletting of Urban Property (Regulation) Ordinance as amended by Act XXIV of 2021;

 

2. Order that the means test of the respondents Alfred Mercieca (ID 121252M) and Jane Mercieca (ID 83746M) be carried out which shall be based on the means test set out in the Rules of the Continuation Tenancies (Criteria of the Means Test) issued under Article 1622A of the Civil Code and any regulations which replace them, which test shall be based on the income of the lessees between 1st January and 31st December, 2020, and on the capital of the same lessees on the 31st December, 2020;

 

3. Declare and decide that in accordance with Act No XXIV of 2021, the rent shall be revised to an amount not exceeding 2% of the free and unencumbered open market value of the premises 40/1, Triq l-Imħazen, Floriana, and to establish new conditions regarding the lease;

 

4. Orders that if the respondents Alfred Mercieca (ID 121252M) and Jane Mercieca (ID 83746M) does not meet the criteria of income and capital of the means test, the eviction of the same respondent Alfred Mercieca (ID 121252M) and Jane Mercieca (ID 83746M) from the premises in question within a short and peremptory time established by this Board and by not later than two years from the 1st June, 2021.

 

With costs against the respondents who are from now summoned so that a reference to their oath be made and without prejudice to any other action that may sometimes be brought.
