It is hereby notified that by a decree issued on the 3rd of June 2022, the Court of Magistrates (Gozo), Superior Jurisdiction, General Section, ordered the publication of the extract reproduced hereunder so that for every purpose and effect of the law serves as notification in accordance with article 931 et sequitur of the Code of Organization and Civil Procedure.
By decree given by the Court of Magistrates (Gozo), Superior Jurisdiction, General Section on the 3rd of June 2022 in the acts of the Schedule of Deposit bearing number 123/2022 SG of Miriam and Jonathan Spouses Vella holders of Identity Card Numbers: 4682(G) and 9283(G) respectively; Simon Farrugia, holders of Identity Card Number: 1779(G) and Cory Farrugia holders of Identity Card Number: 30476(G). That by means of a deed of donation dated fourteenth (14th) of December of the year two thousand and twenty one (2021) in the acts of Notary Doctor Anna Maria Mizzi, copy hereby attached and marked as Document “A", applicant, Miriam Vella, acquired a portion of undevelopable land, known as “Iċ-Ċnus", in the limits of Saint Lawrence, Gozo, having a superficial area of about seven hundred and eight square metres (780 sq.m.) bound on the South West with a road in the fields, East by property of Joseph Grima, and North by property in the possession of Architect Teddie Busuttil or more correct boundaries, subject to the non-revisable, annual and perpetual ground rent of two Maltese cents and five mills (Lm0.02c5) today equivalent to six euro cents (€0.06c), free and unencumbered, with all its rights and appurtenances, and better shown on this site plan attached and marked as Document “B".
That by means of the same deed of donation dated fourteenth (14th) of December of the year two thousand and twenty one (2021) in the acts of Notary Doctor Anna Maria Mizzi, [vide copy Document “A"] applicants, Simon and Cory siblings Farrugia acquired in equal and undivided shares between them, a portion of undevelopable land, known as “Menqa taʼ Kurrat", in the limits of Saint Lawrence, Gozo, having a superficial area of about three thousand six hundred and eighty three square metres (3,683 sq.m.) bounded on the West by the shore, North with a valley, and East with a passage or more correct boundaries, subject to the non-revisable, annual and perpetual ground rent of two Maltese cents and five mills (Lm0.02c5) today equivalent to six euro cents (€0.06c), free and unencumbered, with all its rights and appurtenances, and better shown on this site plan attached and marked as Document “C".
That with regards to the portion of undevelopable land, known as “Iċ-Ċnus" in the limits of Saint Lawrence, Gozo, the ground rent arrears for the last five (5) years amount to thirty-euro cents (€0.30c);
That with regards to the portion of undevelopable land, known as “Menqa taʼ Kurrat" in the limits of Saint Lawrence, Gozo, the ground-rent arrears for the last five (5) years, amount to thirty-euro cents (€0.30c);
That applicants wish to avail themselves of the faculty granted to them in terms of Article 1501 et seq of the Civil Code and redeem this annual and perpetual ground rent which burden their respective portions of land;
That the amount of six-euro cents (€0.06) regarding the undevelopable land, known as “Iċ-Ċnus", in the limits of Saint Lawrence, Gozo, capitalized at the rate of five per cent (5%) amounts to one euro and twenty cents (€1.20);
That the amount of six-euro cents (€0.06) regarding the undevelopable land, known as “Menqa taʼ Kurrat", in the limits of Saint Lawrence, Gozo, capitalized at the rate of five per cent (5%) amounts to one euro and twenty cents (€1.20);
Therefore: the plaintiffs are bringing before this Honourable Court and under its authority
applicant Miriam Vella is depositing under the Courtʼs Authority the global sum of one euro and fifty cents (€1.50) representing as to thirty euro cents (€0.30) ground-rent arrears for these last five (5) years whereas the remaining one euro and twenty cents (€1.20) are the redemption of the annual and perpetual ground rent burdening the portion of undevelopable land known as “Iċ-Ċnus", in the limits of Saint Lawrence, Gozo, as described above; and
applicants Simon and Cory siblings Farrugia are depositing under the Courtʼs Authority the global sum of one euro and fifty cents (€1.50) representing as to thirty euro cents (€0.30) ground-rent arrears for these last five (5) years whereas the remaining one euro and twenty cents (€1.20) are the redemption of the annual and perpetual ground rent burdening the portion of undevelopable land known as “Menqa taʼ Kurrat", in the limits of Saint Lawrence, Gozo, as described above.
These sums are to be released to the person who in accordance with the law has a right to withdraw them and this after leaving due receipt according to law in full and total satisfaction of the amount due.
You are therefore ordered to affix an official copy of these banns at the entrance of this Court and to summon whosoever wishes to act as curator to appear before this registry within six days and by means of a minute to submit a declaration that he wishes so to act.
You are also ordered to inform each one that if he fails to make this declaration within the stipulated time, the Court will proceed to the selection of curators of office. And after so acting or if you should encounter any difficulty in the execution of these banns, you are to inform forthwith this Court.

Bank of Valletta p.l.c (C2833) of 1/5 Misraħ San Ġorg, Valletta, VLT 1190 filed a Claim on the 31st January 2022, whereby they asked the Court to condemn Matthew Carter (ID 560288M) of Blossom Flats, Flat 6, Triq il-Marfa, Mellieħa, to pay the plaintiff company the sum of €10, 207.10 which amount is due to the plaintiff company.
