By means of a judicial letter filed in the First Hall of the Civil Courts on the 4th July, 2023, by Joseph Farrell (ID 94945M) and his wife Antonia Farrell (ID 960246M) of 1, Equinoxe, Triq l-Isqajjaq, Ħal Tarxien against deputy curators to represent the absent Charlie Dalli (Australian passport number PB3279366) residing in Victoria, Australia; the absent Greco sive Grazio Dalli (Australian passport number PA6646752) residing in Victoria, Australia, the absent Peter Cutajar (Australian driving licence, Victoria, number 042190510) and any other heir presently unknown and/or asbsent of the late Lucia Sultana (ID 0057432G) and Carmelo Sultana (ID 0032636G) and/or for the vacant inheritance of the same late Lucia Sultana (ID 0057432G) and Carmelo Sultana (ID 0032636G), Joseph Farrell and his wife Antonia Farrell in the first place they refer you to the fact that amongst both the interpellants individually rendered services, assistance and performances of every sort, to Lucia Sultana (ID 0057432G) who died on the 1st April, 2019, as well as her brother Carmelo Sultana (ID 0032636G) who died on the 8th September, 2020, and that both resided at number 22, Angela, Triq l-Isqajjaq, Ħal Tarxien, which services were of extensive nature and grave due to their sickness assistance over the years, also with the hope of compensation and/or payment but for which services, assistance and performances, the interpellants never received any compensation or payment, as is their right.
In the second place, they also refer you to the service rendered to you by the interpellant consisting in the discovery of prospective sellers and subsequent negotiations, so that by the present day, a promise of sale was made by you in favour of third parties of property with address number 22, Angela, Triq l-Isqajjaq, Ħal Tarxien. The interpellants are from now holding you responsible for any brokerage and/or compensation due to them according to law in case such sale happens, and in default or in case the said sale does not coclud, for any just compensation for the services rendered to you by the same interpellant.
Thus, in view of the above, the interpellants solicit you so that within one week from the service of this judicial letter as the universal heirs of the same deceased, Lucia Sultana (ID 0057432G) who died on the 1st April, 2019, as well as her brother Carmelo Sultana (ID 0032636G) who died on the 8th September, 2020, and both resided at number 22, Angela Isqajjaq Street, Ħal Tarxien, come forward for the liquidation and payment of all the services above referred to by the interpellants individually to the deceased brothers Sultana during their lives.
In default, the interpellants will have no alternative but to proceed against you legally and judicially to safeguard all their interests and rights including by means of the opportune warrants.
This judicial letter is being sent in terms, for all intents and purposes of law, including those of Article 2156 of the Civil Code (Cap. 16 of the Laws of Malta).
So much so that you may know how to regulate yourselves and avoid further costs.
