By means of a decree delivered by the Court of Appeal (Superior jurisdiction) on the 22nd May 2023, in the records of Appeal application No. 382/1990 in the names John and Emanuel brothers Debattista vs Josephine Debattista and Carmen wife of Manuel Sammut as directors on behalf and in representation of the company Innag Household Limited and the same Josephine Debattista, Carmen wife of Manwel Sammut, Anthony Debattista and Anthony Mallia as shareholders in the same company as well as Manwel Sammut as Head of the community of acquests between him and his wife Carmen and administrator of the paraphernal property of his wife, the Court ordered this publication in regard to the above mentioned Anthony Debattista in terms of section 187 (3) et sequitur of Chapter 12 of the Laws of Malta.

 

Whereas by means of the Appeal application number 382/1990 in the names above mentioned, the appellants John (ID 894445M) and Emanuel (ID 510249M) brothers Debattista filed an appeal on the 13th April 2023 against the judgment of the First Hall of the Civil Court delivered on 10th July 1998. The appellants felt aggrieved by part of this judgment, the dismissal of the third and fourth claims together with costs, and are filing this appeal therefrom.

 

Therefore the mentioned appellants respectfully request that this Honourable Court of Appeal, inter alia confirms the judgment appealed delivered on the 10th July 1998 wherein the court upheld the first and second claims, and revokes the rest of the judgment whereby it dismissed the third and fourth claims regarding the responsibility of the respondents for the loss that the company made due to their behaviour and instead (i) uphold the third and fourth claims (ii) or refer the records of the proceedings back to the Commercial Court in order to liquidate damages in favour of the appellants or pass on to determine itself the amount of damages suffered by John Debattista and Emanuel Debattista. By means of a decree delivered by the Court of Appeal (Superior jurisdiction) on the 8th August, 2023, in the records of Appeal application No 322/2023 in the names Reactilab Limited (C-56095) vs Water Services Corporation (as the Contracting Authority) and Ferox Trading Limited (C-97001) (as the recommended Tenderer), the following publication was ordered for the purpose of effecting service on the respondent Ferox Trading Limited, in terms of section 187(3) et sequitur of Cap 12 of the Laws of Malta.

 

Whereas by means of the Appeal application number 322/2023 in the names mentioned above, Reactilab Limited filed on the 26th June, 2023 an appeal application in terms of the Public Procurement Regulations (S.L. 174.04) following a decision by the Public Contracts Review Board given on the 6th June, 2023, regarding the call for tenders number WSC/T/78/2022 Supply, Delivery, Installation and Commissioning of Water Quality Monitoring Stations and Instrumentation for AI in Water Blending for the Water Services Corporation. The company felt aggrieved by that decision and filed an appeal based on three grounds of appeal, namely: i) The Review Board completely ignored the grievances of Reactilab; ii) the Review Board ignored the evidence and technical submissions brought forward by Reactilab and iii) without prejudice to the grievances on the merits, the Review Board was wrong in rejecting the claim for reimbursement of the deposit and/or part thereof.

 

Therefore the appellant Reactilab requests that this Honourable Court revokes and annuls the decision of the Public Contracts Review Board number 1876 of the 6th June, 2023, regarding the call for Tenders WSC/T/78/2022 - Supplies - Supply, Delivery, Installation And Commissioning of Water Quality Monitoring Stations and Instrumentation For AI In Water Blending For Water Services Corporation - LOT 1 so that Reactilabʼs bid be declared as the winning bid, and/or give such other orders and provisions as it deems fit and fair including that the evaluation be made anew and/or that the call for tenders be cancelled with costs against the respondents or whoever is responsible.

Whereas the appellants felt aggrieved by this judgment and brought forward three grounds of appeal in support of their appeal, regarding a) the failure of payment of the deposit on account of the price was a valid reason enough so that the Court could resolve the preliminary agreement b) the Court of First Instance rewarded those who consistently and voluntarily chose to deprive the applicant of the deposit on account of the price, and c) there was a wrong evaluation of the evidence regarding the question of measurement.

 

Therefore the appellants humbly request that this Honourable Court cancels and revokes the judgment of the First Hall Civil Court of the 28th February 2023 in the names premised, and thus pass on to uphold the applicantsʼ demands and reject all the pleas of the respondents, with costs of both instances against the respondents.

Whereas by means of the Appeal application of and Cross Appeal Number 470/2019 in the names above mentioned the Malta College of Arts, Science and Technology (MCAST) in terms of section 240 of the Code of Organisation and Civil Procedure filed an Appeal application and a Cross-Appeal on the 23rd November 2022 against the judgment delivered on the 29th September 2022 by the First Hall of Civil Court on the grounds that the Court of First Instance reached the wrong conclusion because it failed to evaluate the evidence adduced and that the appellant College was erroneously not non-suited in the judgment.

By means of a decree delivered by the Court of Appeal (Superior jurisdiction) on the 22nd May 2023, in the records of the Appeal application No 269/2019 in the names Martin (ID 653553M) and Maria Micallef (522557M) vs Joseph Sawyer (ID 15675M) and Shirley Sawyer the following publication was ordered for the purpose of effecting service on the said Martin and Maria Micallef, in terms of section 187(3) et sequitur of Cap 12 of the Laws of Malta.

 

Whereas by means of the Appeal application number 269/2019 in the names mentioned Joseph Sawyer and Shirley Sawyer filed an Appeal application on the 16th March 2023 against the judgment delivered on the 23rd February 2023 by the First Hall of the Civil Court which appeal is based on seven grounds, inter alia that the Court of First Instance as presided by Mr Justice Francesco Depasquale wrongly decided that the roof de quo was an undivided property, it erroneously rejected the plea of prescription under Article 2140 of Cap 16, and the Court of First Instance failed to evaluate the bad faith of the respondent plaintiffs and did not appreciate that before it there were two conflicting contracts. Furthermore and consequently the judicial expenses were wrongly applied.

 

Therefore, the appellants are respectfully asking this Honourable Court of Appeal to annul and revoke the decision delivered by the First Hall of the Civil Court, dated twenty-third (23) of February of the year two thousand and twenty-three (2023), and subsequently uphold this appeal, with costs of both instances against the respondents.
