It is hereby notified that by virtue of a decree given on the 27th of June, 2023, given by the Court of Magistrates (Gozo) Superior Jurisdiction, General Section, in the records of sworn application number  36/2023(SG) in names 'Paul Portelli vs Joseph Portelli' filed in the Registry of the said Court on the 10th of April, 2023, the publication of the extract reproduced hereunder was ordered and this in order to serve as a notification in regard to the respondent Joseph Portelli of 64, Triq il-Knisja, Nadur, Gozo, and this in terms of article 187(3) of Cap. 12 of the Laws of Malta.

 

Whoever receives this sworn application against him must present his sworn reply within twenty (20) days from the date of notification, namely from when he receives it. Respectfully declares and on his oath Paul Portelli (identity card number 41347 G) confirms:

 

1. Whereas the plaintiff tills fields known as 'Ta' Majża' within the limits of Nadur, Gozo;

 

2. Whereas the defendant Joseph Portelli has fields in the same area that the plaintiff must pass over to access his field;

 

3. Whereas to access his land the plaintiff always used a passageway of five feet wide so much so that until a little while ago he used to pass through this passageway with a plough with a trailer and this made it easier for him to be able to carry material that is needed in his field as well as to carry out the crops with the same plough with its trailer;

4. Whereas the defendant just last October (of the year two thousand and twenty-two (2022)) reduced this passageway to about four feet in such a way that from then on the plaintiff could not anymore get access to his field with the plough with its cart;

 

5. Whereas this led to the plaintiff not being able to continue tilling his field with the same ease as  he used to till it before since the access to the same field was restricted by the defendant;

 

6. Whereas therefore the plaintiff sent a judicial letter to the defendant which letter bears the number  640/2022;

 

7. Whereas the plaintiff is cognizant of all these facts personally.

 

The defendant Joseph Portelli therefore has to state why this Honourable Court should not, prior to giving any order that it deems appropriate and opportune:

 

l. Declare that the plaintiff has a right of way through a five feet wide passageway to his field in the 'Ta' Majża' area within the limits of Nadur, Gozo;

 

2. Declare that the defendant has reduced this passage from five feet to four feet in such a way that the plaintiff cannot access his field with a plough with its trailer;

 

3. Consequently, order the defendant to widen again the passage to what was it before October 2022 and this in a short and peremptory time that will be prefixed to him, and in default order the plaintiff to do these works if necessary under the supervision of an architect appointed for this purpose by this Honourable Court

 

With costs, including those of the judicial letter number 640/2022, of the preliminary letters, and with the summons of the defendant for his testimony.

The interpellant company informs you also that this sum of arrears increases by €296.84 per month after that date.

 

Informs you that if you fail to pay all the arrears due within fifteen days from the date of notification of this letter, the entire balance of the loan becomes due all at once besides the legal interest at the rate of 8% per annum until the date of effective payment.
