That the applicant is the owner of the fields, including any benefice contained therein, including a farmhouse and a water mill (noria) and ponds, in a rural area, known as Ta' Sant'Antnin, Tal-Mastru, Ta' Bur Ħummejr, of Ta' Bur Lublieba, Marsaskala, forming part of a whole territory from where one can enter to it from an unnumbered gate in Triq iż-Żinżell, opposite the very back end of Razzet tal-Ħbiberija which is found in Triq Sant'Antnin, measuring approximately 12,180 sq.m. bounded on the west by Triq iż-Żinżell, from the east by the land of Rafel Debono or his successors in title, from the west with the land of Angelo Spiteri or his successors in title, as shown delineated in the attached site plan and marked as Doc. AA1;

 

That this property was acquired by the applicant's father, Lino sive Carmelo Daniel Abela by means of two contracts;

 

That Lino sive Carmelo Daniel Abela had acquired by means of a contract of sale dated 23rd February, 1966, in the records of Notary Carmelo Lia (hereby attached and marked Doc. AA2) the part of the land covering an area of four tumoli and no sighan and five kejliet subject to sub-groundrent in the amount of six liri, thirteen shillings and eight pence (£6.13.8) equivalent to €16.28 payable to Anthony and Maria Borg and the annual and perpetual groundrent in the amount of one lira six shillings and four pence (£1.6.4) equivalent to €3.07 payable to Catherine Cauchi or her successors in title;

 

That by means of a contract of the 23rd December, 1966, in the records of Notary Carmelo Lia (here attached and marked as Doc. AA3), Lino sive Carmelo Daniel Abela had acquired three other parts of the land and namely the lands known as Ta' Sant'Antnin, Tal-Mastru and Ta' Bur Ħummejr, the land known as Ta' Sant'Antnin covering an area of four tumoli subject to the annual and perpetual groundrent of shilling and three pence (£0.1.3) equivalent to €0.17, the land known as Tal-Mastru covering an area of two tumoli four sigħan and four kejliet subject to the annual and perpetual groundrent of five shillings and five pence (£0.5.5) equivalent to €0.63; and the land known as ta' Bur Ħummejr covering an area of three tumoli subject to the annual and perpetual groundrent of three shillings (£0.3.0) equivalent to €0.35 all payable to the unknown direct owners;

 

That Lino sive Carmelo Daniel Abela died on the 6th April, 2019, and left a will unica charta by means of which Anna Abela was nominated as universal heir of all his property, which includes the fields, including any benefices therein, including a farmhouse and with water mill (noria) and ponds, in a rural area, named Sant'Antnin, Tal-Mastru, Ta' Bur Ħummejr, Ta' Bur Lublieba, Marsaskala (copy of the declaration causa mortis annexed and marked as Doc. AA4);

 

That the applicant wishes to avail herself of the faculty given to her by Article 1501 of Cap 16 and redeem this groundrent;

 

That the sum of €16.28 capitalised at 5% amounts to €325.60 payable to the heirs of Anthony and Maria Borg;

 

That the sum of €3.07 capitalised at 5% amounts to €61.40 payable to the heirs of Catherine Cauchi or her successors in title;

 

That the sum of €0.17 capitalised at 5% amounts to €3.40 payable to the unknown owners;

 

That the sum of €0.63 capitalised at 5% amounts to €12.60 payable to the unknown owners;

 

That the sum of €0.35 capitalised at 5% amounts to €7 payable to the unknown owners;

 

That furthermore, the applicant by means of this schedule of deposit is depositing also the arrears of five years which amount to €102.50;

 

Thus, the applicant is calling upon this Honourable Court and under its authority deposits the total sum of €512.50 to be freely withdrawn by the respondents, against the release of the solace received according to law.

That Romina and Darren spouses Falzon separated their property and dissolved the community of acquests by means of a contract in the records of Notary Brenda Jane Camilleri Vella here attached and marked Doc. BB and thus for this redemption the applicant is presenting this schedule of deposit alone;

 

That the said Raymond Bonavia and others built the block of which the property on sale forms part, on the site previously occupied by the premises previously officially numbered 1 previously numbered 55 with the name Leo Taurus, which they bought from the power of Paul and Angele spouses Pace, by a deed of Notary Carmel Mangion of the 13th July, 2007,

 

The spouses Pace had bought the same premises from the power of Francis Mamo, by deed of Notary Joseph Spiteri of the 30th July, 1987;

 

That Francis Mamo acquired the premises from the power of John Mary Camilleri by deed of Notary Dr Joseph Spiteri dated 8th June, 1981;

 

The same John Mary Camilleri had built the premises on part of the divided portion of land known as plots not officially known with the letters B, C, D, E, F and G on a plan annexed to a deed of Notary Dr Francis X. Micallef dated 9th February, 1966, together measuring approximately 1,270 sq.m. equivalent to 289 square canes bounded on the north and east by a road leading to Wied il-Għasel, and from the south west with a divided part of the same lands known as Tal-Ħanqa, in Mosta, which he acquired from the power of Michelangelo Gatt in virtue of a deed in the records of Notary Dr Francis X. Micallef dated 21st December, 1966, which lands were subject to the annual and perpetual subgroundrent of five shillings and nine pence every square cane. Thus, the sub-groundrent which aggravated this land amounts to Lm80.92 today equivalent to €191.30;

 

That according to the contract in the records of Notary Doctor Carmel Mangion of the 13th July, 2007, the house Leo Taurus, Valley Road, Mosta, is burdened by an annual and perpetual sub-groundrent of Lm 20 today equivalent to €46.58;

 

From further research of the said property it resulted that the property was given by perpetual sub-emphyteusis in virtue of two acts in the records of Notary Dr Francis Micallef of the 19th November, 1961, and by perpetual emphyteusis in the records of Notary Dr Carmelo Giuseppe Vella of the 13th August, 1949;

 

That thus the site where the premises of the applicant is built is subject to the annual and perpetual sub groundrent of €46.58;

 

That the applicant does not know who the owners and/or heirs of the owners are. That thus the applicant is together with this schedule of deposit and redemption of groundrent is proceeding for the nomination of deputy curators;

 

That the same interpellant today wishes to avail herself of the faculty given by Article 1501 of the Civil Code, Cap. 16 of the Laws of Malta, and thus redeem the groundrent above referred to which aggravates the property;

 

That this property today constitutes the sole and ordinary residence of the applicant;

 

That this groundrent on the land on which today there is the premises of the applicant amounts to €46.58 because the subgroundrent which aggravates all the land is of five shillings and nine pence every square cane equivalent to Lm0.28 today €0.65 for every square cane. Since the premises of the applicant has an area of 86 sq m equivalent to 19.59 sq canes the subgroundrent which aggravates it is €12.78 per annum capitalised at the rate of 5% which amounts to €255.60. That this is the most precise method at the disposition of the applicant in order to calculate the rate of groundrent which their premises holds;

 

That the applicant, together with the present schedule of deposit, is also depositing the sum of €63.90 representing the arrears of groundrent due for these last five years.

 

Thus, the applicant calls upon this Honourable Court and under its authority deposits the sum of €319.50 representing.

 

1. As for €255.60 price of redemption of such groundrent to be freely withdrawn by whoever has the right to it after leaving the receipt and thus redeem the groundrent regarding the land above described;

 

2. As for €63.90, the payment of groundrent from the year 2017 till the current year (both inclusive) and this in order to be freely withdrawn by the respondents after leaving the relative receipt according to law.

By means of a decree of the 8th February, 2023, handed down by the Juvenile Court in the records of the application number 239/2022LL in the names Directorate for Child Protection within the Foundation of Social Welfare Services vs Nitaya Ellul, the following publication was ordered for the purpose of effecting service on the respondent Richard Ellul in terms of Article 187(3) et sequitur of Cap. 12.

 

By means of an application in the names Directorate for Child Protection within the Foundation of Social Welfare Services vs Niaya Ellul (ID 64302A) filed in the Juvenile Court, on the 16th November, 2022, the applicant Directorate for Child Protection requested this Honourable Court so that:

 

1. On a preliminary basis and in terms of Article 18(3), it authorises the minor to reside immediately with Doris Agius, mother of Joseph Agius, at her place of residence 10, Triq Barth, Ħamrun;

 

2. That on preliminary basis and in terms of Article 18(3), entrusts the care and custody of minor exclusively in the hands of Doris Agius who shall have the authority to take any decisions in relation to the medical treatment including psychological and psychiatric treatment and educational needs of the minor;

 

3. That if the above requests are acceded to by this Honourable Court, allows the Directorate of Child Protection to release such decree to educational authorities and other entities who will require confirmation of custody of Doris Aguis of the minor … omissis …, however specifically such decree will be officially notified to health authorities to enable Doris Agius to take all necessary decisions if the need arises;

 

4. That all access between the minor and Nitaya Ellul and Joseph Aguis is done under Supervised Access Visits regulated by the Directorate of Alternative Care who shall administer any such contact in the best interest of the minor. This contact shall be affected in accordance to the policies and procedures that govern the Supervised Access Visits Services, within the same Directorate and any revisions to access shall be in competent hands of the Director and any such decisions may lead to increase, decrease, change of modality, change of destination or in serious instances, suspension of access;

 

5. Appoints the present application for a hearing in terms of Article 18(5) of Cap. 602 of the Laws of Malta;

 

6. Appoints a Children's Advocate to provide explanation, to provide any information to the minor, to assist and represent the views of the minor before this Honourable Court in terms of article 25 of Cap 602 of the Laws of Malta;

 

7. Upholds the recommendations, including the issue of a supervision order for the wellbeing of the minor, for the duration of two (2) years, of the Director of the Directorate of Child Protection as put forward in the report attached as Doc, X and makes them an integral part of its final decision and subsequently refers the decision of this Honourable Court to the Directorate of Alternative Care and the Review Board to review the care of the minor in terms of Cap 602 of the Laws of Malta.

 

And this under those provisions that this Honourable Court deems necessary and opportune to impose in the circumstances.

Saw the application of Directorate for Child Protection and the requests therein made dated 16th November, 2022;

 

Accedes to the first request and authorises that by virtue of Article 18(3) of Cap. 602 of the Laws of Malta, the minor at issue … ommiss … should reside with immediate effect with Doris Agius, mother of Joseph Agius, at her place of residence i.e. 10, Triq Barth, Ħamrun;

Accedes to the second request and orders that on a preliminary basis and in terms of Article 18(3) the care and custody of minor is entrusted exclusively in the hands of Doris Agius who shall have the authority to take any decisions in relation to the medical treatment including psychological and psychiatric treatment and educational needs of the minor;

It is hereby notified that by means of an application filed in the Court of Magistrates (Gozo), Voluntary Jurisdiction, on the 15th of September, 2023 (Application number 98/2023) by John Saliba et, the opening of the succession was requested of Luciana Spiteri, spinster, daughter of the late Salvu Spiteri and Giovanna née Mizzi, born in Xewkija, Gozo, and died in Victoria, Gozo, on the 14th of June, 2016 (ID 9450G) which opening of succession should be made in favor of John Spiteri (ID 27666G), Carmel Saliba (ID 10264G), Frances Saliba (ID 12465G) and Joseph Saliba (ID 6772G) in a share quota of thirty-six (1/36) each, in favor of Francesca Spiteri (ID 38648G), Taddeo Spiteri (ID 18657G), Anthony Spiteri (ID 40552G), Angelo Spiteri (ID 60560G), Carmel Spiteri (ID 35446G) in a quota of nono (1 /9) share each, in favor of Carmen Mercieca (ID 12273G) in a quota of nono (1/9) share and a share of twenty seven (1/27), Rita Portelli (ID 87686M) and Mario Spiteri (ID 17680G) in a quota of twenty-seven (1/27) shares each and John Spiteri in a quota of one (1/9) share, the issue of these bands was ordered to let know everyone who may have an interest therein.

 

Therefore, anyone who might have an interest is hereby summoned to appear before the aforementioned Court in order to oppose that request by means of a note within fifteen days which start running from the day of the posting of the banns.

Whereas Carmen Vella filed a writ of summons number 98/2023 (BS) in the names: 'Vella Carmen vs Direttur tar-Reġistru Pubbliku et' demanding corrections in the Act of Birth of Carmen Vella bearing number three hundred and sixty-four of the year one thousand nine hundred and fifty-six (364/1956) and and in every other civil status act relative to Carmen Vella.

 

Whosoever may have an interest therein, and wishes to oppose that demand, is hereby called upon to do so, by means of a note to be filed in the Registry of these Courts, within fifteen (15) days from the day of the publication of this present notice in the Government Gazette.
