Any person who acts in contravention of the court order mentioned in Article 22A, Article 23A, and Article 36 referred to above shall be guilty of an offence and shall on conviction be liable to a fine (multa) not exceeding twelve thousand euro (€12,000), or to imprisonment for a period not exceeding twelve (12) months, or to both such fine and imprisonment.

Any transfer or other disposal of any property made in contravention of the said Court order shall be null and without effect at law.

By a decree given on the 19th of September, 2023, it was ordered that a deputy curator be chosen according to the law to represent the unknown person or persons entitled to the payment of the perpetual ground rent of the immovable described hereunder in the schedule of deposit and redemption of ground rent with reference number 242/2023 in names Excel Investments Limited et vs Deputy Curators in order to represent the unknown person or persons entitled to the payment of the perpetual ground rent of the property described below, which schedule of deposit was presented on the 22nd of August, 2023, in the Court of Magistrates (Gozo) Superior Jurisdiction, General Section, and in all other relative and subsequent acts.

The said schedule of deposit reads as follows:

That by virtue of two deeds published by Notary Kristen Dimech of the 28th of March, 2023, and on the 29th of March, 2023, the applicant Excel Investments Limited bought and acquired:

a) from the possession of Jennifer de Hoog, Rosalinda Portelli, Charles John Muscat, Paul Francis Muscat and Rosanne Sammut:

i. a divided portion of land measuring 249.9 m2 of the land known 'Ta' Patritu' sive 'Tal-Patretua', bordering from the West with Triq San Blas, and from all the other boundaries with the above described property, marked with the letter 'C' on the plan document 'X', subject together with the portions 'B' and 'X' and 'A2' described herein for their annual and perpetual ground rent rate of €0.82 as indicated in the contract of the 30th of August, 1973, in the records of Notary Giuseppe Cauchi and in the contract of the 8th of February, 1941, in the records of Notary Francesco Refalo, and the annual and perpetual sub-ground rent €4.54, as indicated in the contract of the 7th of February, 1948, in the records of Notary Giuseppe Cauchi;

That the applicants Raymond and Grace spouse Camilleri are owners of a divided portion of land already forming part of the same territory known 'Ta' Patritu' sive 'Tal-Patretua' above mentioned, measuring circa 351m2, bordering from the west with Triq San Blas, from the south with the property of Giovanni Vella or his successors and from the east with the property of Giuseppe Borg, or their successors in title, and north with property of the company Excel Investments Limited, marked with the letter 'X' on the plan document 'X', subject together with the portions 'B', 'C' and 'A2' described above to their share of the annual and perpetual ground rent of €0.58 as indicated in the contracts of the 18th of July, 1936, in the records of Notary Francesco Refalo, of the 8th of February, 1941, in the records of Notary Francesco Refalo, and of of the 2nd of April, 1980, in the records of Notary Paul George Pisani, and an annual and perpetual sub-ground rent of €4.54 as indicated in the contract of the 7th of February, 1948, in the records of Notary Giuseppe Cauchi;

That the partition of the land between the company Excel Investments Ltd. and the spouse Camilleri in execution of a sentence of the Court of Magistrates (Gozo), Superior Jurisdiction, General Section, decided on the 15th of December, 2010, in the case in the names: Raymond Camilleri et vs Savior sive Sam Portelli et (Sworn Application number 30/2005) was effected by virtue of a deed in the records of Notary Kristen Dimech of the 19th of April, 2023;

That the applicants wish to redeem jointly and severally between them the ground rent and sub-ground rent mentioned above which altogether amount to €9.20 against the direct owner and the sub-owners who are not known to them nor their heirs or successors in title, and through this schedule of deposit they are taking advantage of the right accorded to them by law and redeem this ground rent and sub-ground rent in terms of Article 1501 of the Civil Code, thus freeing the house and all the land here above described of any burthens. Since the owners or sub owners as well as their successors in title are persons unknown to the applicants, the redemption is being made against a deputy curator nominated to represent the owner or sub owner or their successors in title that they have the right to receive the payment of the redemption of the ground rent and and sub-ground rent;

That the last five ground rents and sub-ground rents are also due, amounting to €46;

That the amount of €9.20 capitalized at the percentage rate of five percent according to the law amounts to €184;

Accordingly, the applicants, with respect, are having recourse to this Honourable Court and deposit under its authority for all purposes and effects of the law in favour of the respondent nomine the global sum of €230, which deposit represents as to the sum of €46 the payment of the last five deadlines of the ground rent and sub-ground rent, whereas the sum of €184 being the redemption of the annual and perpetual ground rent and sub-ground rent of €9.20 capitalized at the percentage rate of five percent according to law, which deposit can be freely disbursed by whoever is entitled to it according to law after due receipt is tendered according to law.

You, executive officer of the Court of Magistrates (Gozo) are therefore ordered to affix an official copy of this notice at the entrance of this Court and hereby summon everyone who wants to enter as a curator to appear in a period of six (6) days in this Register and makes a note declaring that he enters for this.

You are also ordered to inform each one that if he does not make this declaration within the time given above, this Court will proceed to choose a curator of the office. And after you have done this, or if you encounter any obstacle in the execution of this order, you should inform this Court.

4. Order that if the respondent James Naudi does not satisfy the criteria of the income of the means test, the eviction of the same respondent from the premises in question within a short and peremptory time established by this Board.

By a decree given on the 31st August, 2023, by the Civil Court First Hall, the Court ordered that the extract hereunder mentioned be published for the purpose of service according to Article 187(3) of the Code of Organisation and Civil Procedure (Cap. 12).

The apartment internally marked by number three (3) forming part of a block of three flats one on each other built on a underlying garage, which block of flats officially number twenty nine (29) and named 'John-Mary Flats', in Triq Danny Cremona, Ħamrun, and by adecree of the second May of the year two thousand and twenty three (02.05.2023) the Court accepted the request to be amended the description of the said apartment mentioned in the acts of the Judicial Sale. The said apartment has in common with the other apartments the front door, the entrance, underneath the stairs, the stairs to the roof, as well as the same roof and airspace. The overlying airspace of terraces of flat number two (2) from the height of the roof of flat number (2) belongs to owner of flat number three (3). The apartment that is being auctioned has the rights of active and passive servitudes resulting from its relative position and has in common drainage system with the other apartments in the block. The owner of flat number two (2) and the back of the said flat number two (2) up till the height of the roof of same flat number two (2), and the said block is bounded on the east by the said street, west by property of Mr Spiteri, north by property of Mr Giuliano and on the south by property of Mr Joseph Bugeja or other correct compass points.

The said property belongs to Maria Dolores Grech (ID 66543M), Maria Carla Drago (ID 45969M), Alexia Camenzuli (ID 234878M).

DKR 280/2005 – VARIATION OF A FREEZING ORDER

IT IS BEING NOTIFIED that by a decree dated 24th April, 2023 given by the Criminal Court of Appeal (the Hon. Dr Edwina Grima, LLD) after an application filed by Andrea Zammit on the 10th March, 2023, and following judgement given by the same Court on the 12th January, 2016, Bill of Indictment number 44/2007, in the case in the names:

The Republic of Malta

Versus:

ANDREA ZAMMIT, 71 years, son of the late Gerald and Grace née Magro, born in Qrendi, Malta, on the 19th of November, 1951, residing at number 35, Razzett tal-Merħliet, Triq il-Merħliet, l/o Rabat, Malta, and holder of Maltese identity card number 915151M.

The Court ACCEDED to the request of Andrea Zammit and orders that the money which the applicant perceives from the Department of Social Security will no longer be affected by the Freezing Order and therefore can be withdrawn from the bank account 40012940273.

This publication is being published in terms of Cap. 373 and Article 23A(2) of Cap. 9 of the Laws of Malta following a freezing order which decree was given on the 23rd December, 2005, by the Court of Magistrates (Malta) as a Court of Criminal Inquiry and published in the Government Gazette of the 6th January, 2006, where the Court ordered the attachment in the hands of third parties in a general manner, all monies and other movable and immovable property which may be due to or belonging to Andrea Zammit.
