The said schedule of deposit reads as follows:
That by virtue of two deeds published by Notary Kristen Dimech of the 28th of March, 2023, and on the 29th of March, 2023, the applicant Excel Investments Limited bought and acquired:
a) from the possession of Jennifer de Hoog, Rosalinda Portelli, Charles John Muscat, Paul Francis Muscat and Rosanne Sammut:

i. a divided portion of land measuring 249.9 m2 of the land known 'Ta' Patritu' sive 'Tal-Patretua', bordering from the West with Triq San Blas, and from all the other boundaries with the above described property, marked with the letter 'C' on the plan document 'X', subject together with the portions 'B' and 'X' and 'A2' described herein for their annual and perpetual ground rent rate of €0.82 as indicated in the contract of the 30th of August, 1973, in the records of Notary Giuseppe Cauchi and in the contract of the 8th of February, 1941, in the records of Notary Francesco Refalo, and the annual and perpetual sub-ground rent €4.54, as indicated in the contract of the 7th of February, 1948, in the records of Notary Giuseppe Cauchi;

That the partition of the land between the company Excel Investments Ltd. and the spouse Camilleri in execution of a sentence of the Court of Magistrates (Gozo), Superior Jurisdiction, General Section, decided on the 15th of December, 2010, in the case in the names: Raymond Camilleri et vs Savior sive Sam Portelli et (Sworn Application number 30/2005) was effected by virtue of a deed in the records of Notary Kristen Dimech of the 19th of April, 2023;
That the applicants wish to redeem jointly and severally between them the ground rent and sub-ground rent mentioned above which altogether amount to €9.20 against the direct owner and the sub-owners who are not known to them nor their heirs or successors in title, and through this schedule of deposit they are taking advantage of the right accorded to them by law and redeem this ground rent and sub-ground rent in terms of Article 1501 of the Civil Code, thus freeing the house and all the land here above described of any burthens. Since the owners or sub owners as well as their successors in title are persons unknown to the applicants, the redemption is being made against a deputy curator nominated to represent the owner or sub owner or their successors in title that they have the right to receive the payment of the redemption of the ground rent and and sub-ground rent;
That the last five ground rents and sub-ground rents are also due, amounting to €46;
That the amount of €9.20 capitalized at the percentage rate of five percent according to the law amounts to €184;
Accordingly, the applicants, with respect, are having recourse to this Honourable Court and deposit under its authority for all purposes and effects of the law in favour of the respondent nomine the global sum of €230, which deposit represents as to the sum of €46 the payment of the last five deadlines of the ground rent and sub-ground rent, whereas the sum of €184 being the redemption of the annual and perpetual ground rent and sub-ground rent of €9.20 capitalized at the percentage rate of five percent according to law, which deposit can be freely disbursed by whoever is entitled to it according to law after due receipt is tendered according to law.
You, executive officer of the Court of Magistrates (Gozo) are therefore ordered to affix an official copy of this notice at the entrance of this Court and hereby summon everyone who wants to enter as a curator to appear in a period of six (6) days in this Register and makes a note declaring that he enters for this.
You are also ordered to inform each one that if he does not make this declaration within the time given above, this Court will proceed to choose a curator of the office. And after you have done this, or if you encounter any obstacle in the execution of this order, you should inform this Court.

That this block of buildings was transferred to the applicant with all its rights and appurtenances, with all its airspace and its relative subsoil and as subject to the annual and perpetual subgroundrent of €94 as well as all the terms and conditions of the original emphyteutical contracts, whereby this block of buildings was built by the applicant's donors on the divided portion of land which formed part of the field known as Ta' Santa Venera, bounded on the north by the said Triq Misraħ il-Barrieri and on the south and west by property of Costantino Calleja or his successors in title and on the east by property of Michele Frendo or his successors in title which is shown on the plan attached to a deed in the records of Notary John Tabone Adami of the 9th November, 1962;
That this annual and perpetual groundrent is paid in its entirety till today;
That the applicants wish to avail themselves of the faculty given to them by Article 1501 et of Cap. 16 of the Laws of Malta and present a schedule of deposit and redemption of groundrent and sub-groundrent in terms of the same law;
That the applicants are by means of this schedule of deposit redeeming the groundrent and sub groundrent imposed on this divided portion of land pro rata according to the area of 77 square canes for which the applicants pay the amount of €94;
That the original annual and perpetual groundrent is of €35.57 representing a higher groundrent rate imposed by means of the contract published in the records of Notary Dr Carmelo Giuseppe Vella on the 5th January, 1960, which amount capitalised at the rate of 3% amounts to €1,185.66 payable to the respondents Dr Goffredo Randon et and/or their unknown successors in title;
That the annual and perpetual sub-groundrent of €59.93 representing the sub-groundrent imposed by means of a contract in the records of Notary John Tabone Adami of the 9th November, 1962, which amount capitalised at the rate of 5% amounts to €1,198.60 payable to the respondent Carmelo Calleja as one of the successuri of Constantino Calleja.
Thus, the applicants are humbly calling upon this Honourable Court so that under its authority they deposit the global sum of €2,384.26 representing the redemption of this annual and perpetual groundrent and sub-groundrent so that this sum can be freely withdrawn as for the amount of €1,185,66 by the respondents Goffredo Randon et (or their successors in title) and as for the amount of €1,198.60 by the respondent Carmel Calleja and this after leaving the relative receipt according to law
