Order Number 1 of 2022 issued by the Malta Communications Authority
This Order is being issued by the Malta Communications Authority (hereafter the 'Authority') in accordance with article 47(4) of the Electronic Communications (Regulation) Act (Chapter 399 of the Laws of Malta) which empowers the Authority by order in the Government Gazette to amend the rights, conditions and procedures concerning rights of use for radio spectrum where the Authority considers that amendments are minor and after the agreement with the holder of the rights to make such amendments.
Digi B Network Limited (company registration number C35571) holds a Licence entitled 'a Licence for the Grant of Rights of Use of radio spectrum for the establishment and operation of a terrestrial digital audio broadcasting network' (hereafter referred to as 'the Licence'), which Licence expires on the 30 June 2022. Following the publication of the Decision MCA/D/21-4460 by the Authority, Digi B Network Limited has expressed an interest in acquiring the rights of use of radio spectrum for the establishment and operation of a terrestrial digital audio broadcasting network for an initial period of eight years. Upon receiving the expressed interest referred to above, the Authority has initiated the radio spectrum assignment process in question for which no other person has expressed interest. The aforesaid radio spectrum assignment process is currently ongoing.
The Authority considers that pending the conclusion of the process relating to the grant of a new licence related to the aforesaid rights of use of radio spectrum, it is necessary to amend the expiry date of the Licence from the 30th June, 2022, to the 31st March, 2023, this in order to ensure that the rights of use of radio spectrum granted by the Licence continue to subsist until the 31st March, 2023, by when it is envisaged that a new licence shall have been granted. This shall ensure the continued availability of spectrum in relation to the aforementioned terrestrial digital audio broadcasting network.
Therefore, the Authority by virtue of this order is amending the words '30th June 2022' wherever they occur in the Licence with the words '31 March 2023'.
