ORDERED the attachment in the hands of third parties in general of all moneys and other movable or immovable property due to or pertaining or belonging to SHAWN HIGGANS and prohibits the said accused from transferring, pledging, hypothecating or otherwise disposing of any movable or immovable property, and this according to Section 23A (2) of the Criminal Code, Chapter 9 of the Laws of Malta, and Section 5 of the Prevention of Money Laundering Act, Chapter 373 of the Laws of Malta.
The Court AUTHORIZED the said accused to receive the amount authorized by law that does not exceed thirteen thousand, nine hundred and seventy-six Euro and twenty-four cents (€13,976.24) per year, after the accused indicate with a note from where they are perceiving this money.
Any person who acts in contravention of the court order mentioned in Section 23A (2) and Section 5 referred to above shall be guilty of an offence and shall on conviction be liable to a fine (multa) not exceeding eleven thousand and six hundred and forty-six Euro and eighty-seven cents (€11,646.87), or to imprisonment for a period not exceeding twelve months, or to both such fine and imprisonment.
Any transfer or other disposal of any property made in contravention of the said Court order shall be null and without effect at law.

By means of a decree of the 16th October 2020 of the Rent Regulation Board, in the records of the Application in the names Gaetano Attard vs Dolores Muscat et, Application Number 99/2020MV, the following publication was ordered for the purpose of effecting service on the respondent Dolores Muscat in terms of Article 187(3) et seq of the Code of Organisation and Civil Procedure (Cap 12)
By means of an application in the names Gaetano Attard (ID 425657M) vs Dolores Muscat (ID 261045M) and the Housing Authority (as Amicus Curiae) filed before the Rent Regulation Board on the 25th June 2020, the applicant Gaetano Attard (ID 425657M) requested with respect that this Board:
1. Declares and decides that Dolores Muscat is the tenant of the premises 55 Triq San Franġisk, Ħamrun, in terms of Chapter 158 of the Laws of Malta, that was originally given by temporary emphyteusis for a period of 17 years at the annual and temporary groundrent of Lm40 according to the emphyteutical consession of the 6th February 1973 in the records of Notary Mario Bonello;

Orders that the means test of the respondent Dolores Muscat is carried out which is to be based on the means test established in the Rules of the Continuation Tenancies (Means Testing Criteria issued under Article 1531F and 1622A of the Civil Code) and any other regulations that may substitute these from time to time, which test is to be based on the income of the respondent Muscat between the 1st January and the 31st December 2019 and on the capital of the same Muscat on the 31st December 2019;
3. Declares and decides that in terms of Act XXVII of 2018, the rent has to be revised to an amount which does not exceed 2% per annum of the value free and unencumbered in the open market value of the premises 55, Triq San Franġisk, Ħamrun and to establish new conditions regarding the rent, and in default if the respondent Muscat does not satisfy the critiria of the means test of his income and capital the respondent is given a period of five years within which to vacate the premises, besides paying a compensation to the applicant for the occupation of the premises during the said period that amount to double the rent that was paid according to Article 12 and 12 A of Chapter 158 of the Laws of Malta and this according to the current rent in terms of Act X of 2009 that cannot be considered as less than the annual rent due on the 1st January 2019 when the same rent rises on the three years before.
4. Orders, that in case the respondent Dolores Muscat does not satisfy the criteria of the income and capital of the means test, the eviction of the same Dolores Muscat of the premises 55, Triq San Franġisk, Ħamrun within a short and peremptory time established from this Board after five years from the judgement so that the premises will be vacant.
With costs against the respondent who is from now summoned so that reference to his oath be made and reserving without prejudice for any other action that may be filed.

That the applicants respectively acquired from Ganni Bonavia Builders Limited (C42739) the following properties forming part of a block without official number but called Highwoods, in Triq il-Palma, Swieqi, bounded from the North and the North West with Triq il-Palma, and for the other boundaries with properties of third parties, previously occupied by a house with official number 13 with the name Rorory, consisting of three apartments, penthouse and garage complex, subject together to the annual and perpetual groundrent of €16.31 previously Lm7 which block is found as shown in the site plan here attached and marked as Doc A1 with the total measurement of 195 square meters, the following:
a) Martin Chetcuti (ID 261458M) and Carmen Chetcuti (ID 244358M) – the apartment number 1 found at the elevated groundfoor of the same block and also the parking space internally marked number 1 forming part of the garage complex, that is found uner the block named Highwoods, by means of a contract of sale dated 24 th June 2016 in the records of Notary Dr Andre Farrugia (here attached as Doc A2) as subject to the annual and perpetual groundrent of €4.08;
b) Staffan Martin Bergh (ID 49366A) and Analise Deguara (ID 245184M) the apartment number 2, found at the first floor of the same block by means of a contract of sale dated 24th February 2016 in the records of Notary Dr Matthew Nicholas Borg (here attache as Doc A3-A) – as corrected by means of a correction act dated 4th March 2016 (Doc A3-B also attached) as subject to the annual and perpetual groundrent of €3.00;
c) Bastille Malta Trustee Limited (C25994) the apartment number 3 found at the second floor of the same block by means of a contract of sale dated 19th April 2016 in the records of Notary Dr Ann Marie Agius (here attached as Doc A4-A) and the garage number 1 forming part of the garage complex that is found under the same block by means of another contract published on the 12th September 2017 (here attached as Doc A4-B) as subject to the annual and perpetual groundrent of €4.08 after an indication was made to this effect by means of a deed of correction of Notary Dr Anne Marie Agius of the 8th January 2019 (Doc A4-C attached);
d) Elaine Cuschieri (ID 162281M) – the penthouse with its own airspace, internally marked with number 4 and the garage internally marked with number 3 forming part of the garage complex that is found under the said block called Highwoods including the underlying part under the ramp and part of the drive-in of measurement of 48 square meters, by means of a contract of sale of the 5th November 2014 in the records of Notary Dr Joseph Abela (here attached as Doc A5-A) as subject to the rate of annual and perpetual groundrent of €4.08 after an indication was made to this effect in a Correctory deed published by Notary Joseph Abela of the 24th October 2018 (Doc A5-B attached).
At the same time, the applicant company Ganni Bonavia Builders Limited (C42739) is, till now, still in possession and the owner of its own property the garage number 2 that forms part of the garage complex of the same block and also the basement under the same garage complex with the execption of that part of the basement that is found under the ramp and part of the drive-in of measurement of about 48 square meters that was already sold to Elaine Cuschieri, as subject to the remaining groundrent calculated in the amount of €1.07;
As indicated before the block of which the properties above mentioned form part, was built instead of a house with its own airspace and the interconnected garage with official number 13 with the name Rorory, in Palm Street, (Triq il-Palma), Madliena/Swieqi limits of San Giljan, before limits of Gharghur after the same house was acquired by the company Ganni Bonavia Builders Limited (C42739) by means of a contract dated 3rd July 2009 in the records of Notary Malcom Licari here attached and marked as Doc B.
That according to this contract, this house was built on a plot of land previously 23, bounded from the North with the said road above mentioned and from the East with property of Paul and Rocco brothers Buhagiar, or their successors in title and from the West with property of Zachariah Calleja, as also shown, that according to the same contract is subject to the annual and perpetual groundrent of €16.31 previously Lm7 as subject to the payment of laudemium, otherwise free and unencumbered with all its rights and appurtenances and with its vacant possession.
That effectively according to the contract above mentioned in the records of Notary Malcolm Licari it was also indicated that this land was previously acquired by means of a contract in the records of Notary Paul Pullicino dated 17th July 1991 (Doc C attached) by Raymond and Rose Micallef according which contract then it resulted that this land was acquired from Zachariah Calleja as subject to the annual and perpetual groundrent of Lm7.
That according to the same contract of 1991 on his part Zachariah Calleja acquired the same land as part of a larger land from Paul and Rocco Buhagiar by means of a contract dated 5th December 1987 in the records of Notary Antoine Agius.
On their part Paul and Rocco Buhagiar by means of a contract of sale in the records of Notary Joseph Agius dated 27th November 1981 acquired a bigger portion of land measuring 7,159 meters squared subject to the sub groundrent of Lm2,210 (that including the original groundrent of Lm210) from Lay Lay Company limited and by means of it the sub groundrent was redeemed through of a contract in the records of Notary Antoine Agius of the 4th December 1981 as shown in the contract of the 17th July 1991 that has been just mentioned, whilst the original groundrent remained not redeemed – so the redemption of the amount of Lm7, shown in the following contract refers to the said plot.
That according to the contract of the 27th November 1981 above mentioned and here attached as Doc D, it should result that on its part the company Lay Lay Company Limited acquired the part of the land measuring 8,992.8 square meters known as Ta' Kafkaf, on a part of which, the property acquired by Ganni Bonavia Limited (from British Overseas Trading Company Limited and Sullivan and Sullivan Limited) by means of a contract dated 23rd September 1980 in the records of Notary Antoine Agius subject to the annual and perpetual groundrent of Lm256, was built.
That according to the contract above mentioned the land was indicated that it was acquired previously from John Spiteri by means of a contract dated 27th May 1964 in the records of Notary Paul Pullicino (Doc E attached) which contract confirms that this land was subject to the perpetual sub-groundrent (and not groundrent) of Lm256.
That in fact according to the contract above mentioned, John Spiteri acquired the same land by title of perpetual groundrent from Giovanni Grech by means of a contract in the records of Notary Joseph Spiteri dated 29th December 1961 (Doc F attached) indicated with the measurment of about eight tumoli at the annual and perpetual groundrent of Lm60 payable every year in arrears and so it results that the said John Spiteri imposed further groundrent when he sold the land as indicated in the contract dated 27th May 1964 in the records of Notary Paul Pullicino.
Thus this schedule of deposit is intended to redeem the original groundrent imposed by Giovanni Grech on the contract in the records of Notary Joseph Spiteri dated 29th December 1961 and also the subsequent sub groundrent imposed by Architect John Spiteri by means of a contrfact dated 27th May 1964 in the records of Notary Paul Pullicino.
That according to the contract of the 27th May 1964 the increase in the groundrent and that is the subgroundrent that was imposed on the portion of the relative land that can be redeemed in favour of John Spiteri could be redeemed at the rate of 3% whilst the groundrent imposed by means of the contract dated 29th December 1961 it seem that can be redeemed at the capitalisation rate of 5% as indicated by law.
That the proportion of the original groundrent of Lm60 that was imposed on the measurement of about eight tumoli (taking the measuremnt of 221.4 meters squared indicated in the contract of 17th July 1991 indicated above from a superficial measurement that is being used for all intents instead of the measurement of 212 square meters as indicated in the plan of the block attached), and that is being redeemed by means of this schedule of deposit from the groundrent of €16.31 previously Lm7 is being calculated that is equivalent to Lm1.48 that is €3.45;
That consequently the subsequent subgroundrent is being calculated that is equivalent to Lm5.52 (12.86) taking into accounts the fact that the total groundrent that is being redeemed by means of this schedule of deposit is that of Lm7.
That the amount above mentioned of €3.45 (Lm1.48) of the original perpetual groundrent regarding this schedule of deposit imposed by Giovanni Grech as capitalised at the rate of 5% amounts to €69.00;
The the amount above mentioned of €12.86 (Lm5.52) of the perpetual sub-groundrent regarding this schedule of deposit imposed by Architect John Spiteri as capitalised at the rate of 3% amounts to €428.66;
That the groundrent due for these last five years is equivalent to €17.25 with respect to the original groundrent and €64.30 with respect to the subsequent sub-groundrent, subject matter of this schedule of deposit.
Thus the applicants in terms of Article 1501 of the Civil Code (Chapter 16 of the Laws of Malta) are humbly requesting this Honourable Court and under its Authority are depositing the amount €497.66 as above split, representing the price of the redemption of the groundrents above mentioned and also the amount of €81.55 representing the groundrent and subgroundrent arrears for these last five years so that these amounts can be freely withdrawn by whoever has a right to it as indicated in the schedule of deposit (or their heirs/succesors in title) after leaving the relative receipt according to law.

That on the 26th January 1998 Victor Camilleri, father of Emanuel, Carmelo, Mary Rose, Doris, Joseph and Anthony brothers and sisters Camilleri, died.
That as results from the testamentary searches, the inheritance of the late Victor Camilleri was regulated by means of two wills made in the records of Notary Marthese Felice on the 23rd November 1993 and on the 8th January 1998 respectively (Doc A). As results from the dispositions of the wills, the late Victor Camilleri left several legacies, whilst he nominated and appointed as his universal heirs of all his estate his six (6) children Emanuel, Carmelo, Mary Rose, Doris, Joseph and Anthony brothers and sisters Camilleri in equal shares between them (Doc B, C and D);
The assets at the bank of the late Victor Camilleri, are still not liquidated and divided. All the applicants want to divide the bank assets and/or finances that belong to the late Victor Camilleri;
Although the respondent was duly notified to come forward for the amicable division of these bank assetes and/or finances, she remained in default;
Joseph Camilleri, son of the late Victor Camilleri, died on the 30th January 2015 wehre in his last will in the records of Notary Joanne Lia dated 27th February, 2012 he nominated and appointed as his universal heirs his wife the applicant Helen Camilleri. In addition, Anthony Camilleri, son of the said Victor Camilleri died on the 26th January 2011 and he was survived by two children that is the applicant Jacqueline Cunningham and the respondent Charoline Camilleri. Thus the aforementioned appearers will inherit their father's portion with the right of representation.
The applicants know about these facts.
Thus these Proceedings had to be filed.
Thus, the respondent is to state why this Honourable Court, subject to any necessary and opportune declaration, should not:
a. Liquidate the bank assetes of the late Victor Camilleri and any other assets that result still not having been divided.
b. Consequently divide, the bank assets and/or finances and/or other assets between the parties, according to their respective shares, as result in accordance with the last wishes of the late Victor Camilleri.
