By means of a decree of the 16th December, 2021, of the Rent Regulation Board, in the records of the Application in the names Mary Rosaria Mills vs Joseph Zerafa et, Application number 783/2021NB, the following publication was ordered for the purpose of effecting service on the respondent Joseph Zerafa in terms of Article 187(3) et sequitur of the Code of Organisation and Civil Procedure (Cap. 12)

 

By means of an application in the names Mary Rosaria Mills (ID 894746M) vs Joseph Zerafa (ID 504258M) filed before the Rent Regulation Board, on the 27th October 2021, the applicant Mary Rosaria Mills (ID 894746M) requested this Honourable Board to:

 

1. Carry out the means test of the respondent, in terms of Article 1622A of the Civil Code and any other regulations that replace them and determine if the respondent meets the criteria of the income and capital of the means test;

 

2. In the event that this Board finds that the respondent does not meet the criteria of the income and capital of the means test:

 

  a) dissolve the lease in favour of the respondent of the urban property 32, Triq Gioacchino Navarro, Msida,

b) give the respondent a period of time, not exceeding two years to vacate the premises and release its vacant possession in good condition to the applicant,

 

c) establish the rent payable by the respondent to the applicant for the occupation of the premises during the said period;

 

3. In the event that this Board finds that the respondent meets the criteria of the means tests for income and capital, revise the rent payable by the respondent for the premises 32, Triq Giacchino Navarro, Msida, for the amount of 2% per annum of the free and open market value of the premises from 1st January, 2021, and condemns the respondent to pay the applicant the increased rent as revised with the same current installments, or with different modifications as this Board deems fit and opportune.

 

With costs against the respondent who is hereby summoned so that a reference to his oath be made and reserving the right to any other action by the applicant if the case may be.

By a Decree of the 16th February, 2022, given by the First Hall Civil Court, the Court ordered that the extract hereunder mentioned be published for the purpose of service according the Article 338 (1) of the Code of Organisation and Civil Procedure (Cap. 12).

 

That by application and a Schedule of set-off filed contemporaneously by Bank of Valletta plc (C2833) on the 14th February, 2022, the approval of the said judicial acts is being demanded for the amount of €150,000 following judicial sale by auction 27/20 in the names Bank of Valletta plc (C2833) vs Carlo Montebello et held under the Authority of the said Court on the 8th February, 2022.

 

According to Article 338 (2) of Cap. 12: Any person who may have an interest and the persons so served shall be allowed the time of twenty days to file an answer stating in detail the reasons for their opposition and the amounts in contestation; and where such opposition is based on a claim against the proceeds of sale an alleged cause of preference, they are to state the amount of such claim and the basis for the preference. Such persons shall with the answer file all relevant evidence to substantiate their opposition.

By a Decree of the 28th October, 2021, given by the First Hall Civil Court, the Court ordered that the extract hereunder mentioned be published for the purpose of service according the Article 338 (1) of the Code of Organisation and Civil Procedure (Cap. 12).

 

That by application and a Schedule of set-off filed contemporaneously by Edwin Borg on the 21st October, 2021, the approval of the said judicial acts is being demanded for the amount of €347,000 following judicial sale by auction 19/21 in the names Edwin Borg vs Dr Leontine Calleja et noe held under the Authority of the said Court on the 19th October, 2021.

 

According to Article 338 (2) of Cap. 12: Any person who may have an interest and the persons so served shall be allowed the time of twenty days to file an answer stating in detail the reasons for their opposition and the amounts in contestation; and where such opposition is based on a claim against the proceeds of sale an alleged cause of preference, they are to state the amount of such claim and the basis for the preference.
