Request with respect:

 

That on the 7th September 2021 in the acts of the judicial sale by auction in the names Bank of Valletta plc vs Issa Isslam Tawfik, the apartment internally marked number 3 that is found on the second floor and forms part of a block of four (4) apartments, which block is without an official number and named Buontempo Estates which is located in an unnamed private street leading to Balzan Valley, Ħal Balzan and which flat is located on the left hand side of the said block when looking at the said block. Included with the apartment is also a quarter (1/4) undivided share of the common parts of the said block of flats and also includes the room on the roof of approximately 35sqm which are accessible from the common parts of the apartment which is bounded on all sides with property of Devicon Limited. The said block is bounded on the southwest, northwest and southeast by the new unnamed road which leads to Balzan Valley, Ħal Balzan and other more precise boundaries. The said apartment enjoys the rights and is subject to the servitudes arising from its position. The said apartment is free and vacant with all its rights and appurtenances;

 

That the applicant is a creditor of the respondent Issa Isslam Tawfik in the amount of €15,000 besides the interest due from the 12th February, 2016, and this according to a judgement which is now final in the names 2R's Limited vs Issa Isslam Tawfik (Sworn Application number 725/2014MH) decided on the 12th February, 2016, and this besides other debts according to the constitution of debt deed of the 28th January, 2014, in the records of Notary Mario Bugeja in the amount of €24,000;

 

That this contract was rendered executable in terms of Article 256 of Cap. 12 of the Laws of Malta by means of an official letter dated 23rd February, 2022;

 

That in guarantee of the debt in favour of the applicant, the respondent Issa Isslam Tawfik constituted in its favour a special hypothec on the said apartment in Ħal Balzan, which hypothec is registered in the Public Registry with the note of registration number H.1400/2014;

 

That to date the applicant still has to receive the total amount of €46,259.18, being the principal sum and interest until the end of February 2022, besides any further interest until the date of effective payment and besides the costs of the lawsuit in the names 2R's Limited vs Issa Isslam Tawfik (Sworn Application number 725/2014MH) decided on the 12th February, 2016, and of the relative appeal that was declared abandoned on the 16th September, 2021;

 

That in terms of article 2069 et sequitur of Cap. 16 of the Laws of Malta and Article 356 of Cap. 12 of the Laws of Malta, the respondents or any of them are obliged to pay the hypothecary debt due to the applicant in its entirety, with interest till the date of effective payment;

 

That in default of full payment in accordance with the law, the respondent Bank of Valletta plc is obliged to leave the premises sold to it by auction on the 7th September, 2021, without any reservations.

 

Accordingly, whilst putting the respondents on notice with all of the above, the applicants solicit:

 

i) The respondents or any of them to pay the total amount of €46,259.18, by way of principal sum and the interest till the end of February 2022, besides any further interst until the date of effective payment and besides the costs of the lawsuit in the names 2R's Limited vs Issa Isslam Tawfik (Sworn Application number 725/2014MH) decided on the 12th February, 2016, and of the relative appeal that was declared abandoned on the 16th September, 2021;

That the description of the airspaces forming part of the airspace located on the third floor level (that is the fourth floor) underlying the airspace on the setback floor level and which airspace has an area of about 145sqm which area includes the balconies included a divided part of the airspace at the setback floor level with the airspcae above the said part of the divided airspace at setback floor level has an area of about 64sqm. This airspace that is found at the third floor level will be developed in an apartment internally marked with the number 3 located on the third floor level (that is the fourth floor) while the part divided by the airspace on the setback floor level, will be developed into a washroom and terrace of the said washroom and terrace with the free airspace of the said washroom and terrace. The airspace of the third floor level is found exactly above a property on the second floor level which will remain the property of the donors while the part divided by the airspace at the setback floor level is found exactly above the part of the air space at third floor level that is being donated to Christian Sciberras.

 

 

 

The air space of the third floor level that is going to be developed in an apartment internally marked with number 3 on the third floor level is bounded from the north with property of Matteo Magro or his successors in title, from the south with a private drive-in and from the east with Triq Filippu Zammit or other correct boundaries. The divided part of the airspace at the setback floor level is bounded from the east with another divided part of the said airspace as setback floor level property of the donors, from the south the a private drive-in and from the north with property of Matteo Magro or his successors in title or with other correct boundaries.

 

The property donated on this deed is being donated as subject to the passive servitudes and also subject to the enjoyment of all the servitudes resulting from its position in the block and enjoys the active rights which results from its position in the block.

 

The donated property on this deed is subject to the annual and perpetual groundrent of €1.55, which groundrent forms part of a larger groundrent of €4.66 previously Lm2 that was imposed on the mezzanine with its airspace above mentioned.

 

That the identity of the owner of this groundrent, and in the eventuality of any possible successors in title and/or heirs are unknown to the applicant, and this in spite of any attempt made by the applicant to learn who they are and thus the same applicant is filing an application so that deputy curators be nominated to represent the unknown owner or owners.

 

The applicant wishes to avail himself of the option given to him according to law and this in terms of Article 1501 of Cap. 16 of the Laws of Malta and redeem the same groundrent of €1.55 regarding the property above mentioned, which relative groundrent has to be redeemed with the rate of 5% and this as stipulated in the same article that is capitalised in the total amount of €31.

 

Thus, the applicant is humbly calling upon this Honourable Court and under its authority is depositing the amount of €7.75 this being the groundrent due for these last 5 years, and also the amount of €31 this representing the redemption of the annual and perpetual groundrent for the total of €38.75 so that they can be freely given to the whomever has the right to them according to law, after leaving the relative receipt according to law.

That it is necessary that the succession of the said Carmen Pollock should be made in favor of her heirs according to law and that is to the quota of half (1/2) undivided in favor of her husband George Anthony Pollock (American passport Number 667322202) and in the quota of half undivided (1/2) between them in favor of the three sons Brian George Pollock (American passport number 521324180), Kevin Robert Pollock (American passport number 521497710) and Janet A Ndzibah (American passport number 662890623), the issuance of this ban was ordered to inform anyone involved.

 

Wherefore, any person who considers to have an interest in the matter is hereby called upon to appear before the said Court and to bring forward his objections hereto by a minute to be filed within fifteen days from the posting of the banns.
