It is hereby notified that in virtue of the powers conferred by Section 257 of the Civil Code, the Court of Revision of Notarial Acts, by a Decree dated the 18th March, 2023, and upon an application numbered 210/2023, ordered:
The Director of the Public Registry to make the appropriate annotations or corrections in the Act of Birth bearing the number 3116/1985, so that it appears that the surname of Mohamed Elbae (including the surname of the father and the paternal grandfather as well the mother's details) should appear as 'Elrae' and not as 'Elbae', and therefore 'Elbae' is deleted wherever it appears and replaced by the correct surname 'Elrae' and this can be done through a general annotation given that back in 1985, the child's surname was not specifically indicated in the Act of Birth.

By means of sworn application number 186/2022AGV in the names Pamela Cauchi (ID 509383M) vs Jesmar Cauchi (ID 39983M), filed in the Civil Court (Family Section), on the 30th August, 2022, the applicant Pamela Cauchi (ID 509383M) requested this Honourable Court to:
1. Pronounce the personal separation between the contending spouses for the reasons imputable to the respondent of services, threats, bad habits and grave injury against the applicant;
2. Order that the applicant has the exclusive care and custody of their daughter, the minor … omissis …;
3. Order that the applicant be authorised to sign her passport and all necessary educational and medical documentation;
4. Agree on adequate access to the respondent Jesmar Cauchi for the minor … omissis …;
5. Approve such accesses of the respondent that he is not in the presence of third parties both male and female and that the respondent does not take the minor to bars;
6. Declare that the respondent has given up all rights for his maintenance according to law;
7. Declare the community of acquests existing between the parties to be dissolved and order the same objects forming part of the community of acquests be divided into two portions that will be assigned to the parties, which portions must be composed by establishing a date when the respondent is considered to be guilty of the separation in such a way that he loses any acquisition made by the applicant according to law, and this by means of nominate architects to liquidate the same community of acquests, and to nominate a notary to receive the relative deed and also curator to represent any person who does not appear on the deed;
8. Apply against the respondent in whole or in part the provisions of Articles 48 and 53 of the Civil Code (Cap. 16 of the Laws of Malta);
9. Exempt the applicant from being responsible for debts that the respondent has or may have;

That the purpose of this judicial protest is to formally put certain facts on record in the Court and that the applicants dissassociate themselves in the most ample and legal way from the respondents and their operation and hold the respondents responsible;
The background is that the applicants were directors, Mr Attard personally and BDO Consult Limited as corporate directors, directors of the two respondent companies together with the respondent Yaniv Meydan. BDO Consult Limited is a licensed Corporate Service Provider with MFSA;
Attached to this judicial protest are copies of letters dated 7th October, 2022, and 21st October, 2022. In the first letter of 7th October 2022, the applicants are registering the fact that the respondents intentionally concealed information (deliberate concealment of information). In addition the Board was misled and misguided and this by the respondents in bad faith such that the Board was deliberately misled. This since, in truth, the financial position of the respondent Companies has been deliberately concealed – this has happened not only by the other director and respondent Yaniv Meydan, but also by their senior Management, as they are today known as the C- Functions and namely the Chief Financial Officer, the Chief Executive Officer and the Chief Operating Officer: these facts were communicated for the first time in a telephone conversation held on the 19th September, 2022, between the applicant Mark Attard and the respondent Yaniv Meydan, who was at that time was co-director and today is a sole director;
A conversation also took place between Mr Mark Attard and the CFO Alexander Kaganovich. In this meeting, the financial information was once again requested, and it was refused to be released without the permission of the respondent Meydan. The information never arrived, and until the date of the resignation, the applicants were left totally in the dark. As the correspondence explains, the information was requested so that the Board of Directors can examine the current and true situation (not the misleading one) and do what should be done according to Law in similar circumstances;
That the applicants waited a few days, because the respondent informed them that there was a possibility of a sale and takeover and they did not want to prejudice the negotiations and perhaps frustrate them, this with a sense of loyalty and responsibility towards the respondents. There was also a long conversation between Mark Attard and the General Counsel of the Genesis Group, Ms Kareen Stone. After these few days and in light of the fact that the financial information was not transmitted, the applicants chose and determined that they had to disassociate themselves in totality and formally from these circumstances and resign as Directors and Secretary of the respondent companies. The attached letter dated 21st October, 2022, explains and registers ad futuram rei memoriam, all this and the effective date of the resignation with the Registrar of Companies (MBR) shows the effective date of change as the 21st October, 2022;
The applicants explain that with the respondents they had a professional relationship of eight years, which was always regular, legal and correct and there was nothing then that could infer otherwise. It was instead the respondents who, in bad faith and with a bad and misleading intention, at some stage, concealed and continued to mislead (deliberately concealing and misleading) the Board of Directors.
Therefore, the applicants, while bringing the above to the formal knowledge of the respondents, reserve all their rights according to Law, disassociate themselves from the respondent companies and the respondent proprio and from the operation including those of all the C-Functions. They reiterate that the operation of the applicants was always correct, legal and regular according to the law, and that the financial information was deliberately concealed and withheld from them and that they were misled as members of the Board of Directors, all this because of the bad faith and deceit of the respondents. Therefore the respondents are being held responsible for all purposes and effects of Law, including for any damages that the applicants may suffer including loss of their image and professional reputation. With due reservation of all rights and actions at law.
