By means of a decree delivered by the Court of Appeal, on the 5th October, 2023, in the records of the Appeal application number 703/2010 in the names Lombard Bank Malta plc (C1607) vs Allegro Andante Limited (C24105), the court ordered the following publication for the purpose of service of John Cutajar residing at 23, ‘Solandra’, Flat 7, Triq Andrea Debono, Naxxar, in terms of section 187(3) et sequitur of Cap. 12.

By means of Appeal application number 703/2010 filed by Lombard Bank Malta plc on the 16th May, 2023, in the names premised the same appellant plaintiff company mentioned felt aggrieved by the judgement of the First Hall Civil Court delivered on the 28th April, 2023, with the grievances as contained in the same appeal.

By means of a decree delivered by the Court of Appeal (Inferior jurisdiction), on the 11th October, 2023, in the records of Appeal Application number 37/2023 in the names JAC Steel Ltd vs the Planning Authority, the following publication was ordered for the purpose of service of the respondent company above mentioned in terms of section 187(3) et sequitur of Cap. 12.

By means of Appeal Application number 37/23 filed by the appellant Planning Authority on the 5th July, 2023, in the names premised, the appellant Planning Authority filed an appeal against the decision of the Environment and Planning Review Tribunal dated 15th June, 2023, by means of which it upheld the appeal and the Notice on the merits 54/15 issued against the respondent and it was declared null and without effect. Whereas the said appellant Authority felt aggrieved by this decision in so far as the Tribunal gave an incorrect interpretation of the applicable law.

By means of a sworn application in the names Andrew Sapienza (ID 496677M) vs Astrid Sapienza (ID 73377M), filed in the Civil Court (Family Section), on the 8th August 2023, the applicant Andrew Sapienza (ID 496677M) on oath requested this Honourable Court to:

1. Declare and pronounce the personal separation between the parties for reasons imputable to the defendant and for the purposes of Article 48 (c) of the Civil Code (Cap 16) establish the date when the same defendant is to be considered guilty of the separation;

2.  Authorise the plaintiff to live separately from the defendant his wife;

4.  Provide provisions and access specifically applicable to particular days including father’s day, mother’s day, Christmas and Christmas nights, new year’s Eve and new year’s day, Easter day, Father’s birthday, mother’s birthday, minor’s birthday and public holidays;

5.  Condemn the defendant to pay the plaintiff the appropriate and adequate maintenance to be fixed by the same Court, according to the means of the defendant and the demands of the plaintiff, payable by the defendant to the same plaintiff both a week or a month as ordered by this Court or if it appears fit to the same Court, order the defendant to pay the plaintiff instead of all or part of that maintenance, a global sum which in the opinion of Court is sufficient so that the plaintiff is financially independent or less dependent on the defendant;

6. Apply against the defendant in whole or in part the provisions of Article 48 of the Civil Code (Code 16);

7. Condemn the defendant to deliver to the plaintiff all his dotal and paraphernal property and separately order that the plaintiff be given the full administration of his paraphernal property;

8. Liquidate the paraphernal credits or rather pecuniary credits of the plaintiff and consider these as credits of the same plaintiff against the Community of acquests of the parties;

9. Declare the Community of acquests existing between the parties as dissolved, liquidate the same Community and order that the same objects forming the Community of acquests be divided into two divided portions as ordered and established by this Court in view, inter alia, of the dates of acquisition of the various objects forming the same Community and of the date established by this Court as the date when the same defendant is to be considered guilty of the separation, which portions are assigned one to the plaintiff and the other to the defendant by an architect who, if necessary for the purposes of this demand, is appointed to carry out the required liquidation and proposes a plan of partition, a notary to publish the relative deed and a curator to represent the eventual defendant on the same deed. Together with the said liquidation and partition, the Court is also asked, so that with the aim that the reciprocal claims of the parties be definitely liquidated in one judgement liquidate the credits brought forward by the parties against each other or against the community of acquests existing between them, dissolve all monies of property existing between the spouses and order the partition according to the law of the property so jointly held in such a manner that such further liquidations and partitions are made together with the liquidation and partition of the property which forms party of the same community of acquests;

10.  Authorise the plaintiff to register, or rather enter, in the Public Registry the judgement eventually given by this Court.

With costs including those incurred in the mediation procedures, against the defendant who is from now summoned so that a reference to her oath be made.
