By means of a decree of the 7th April, 2025, of the Civil Court First Hall in the records of judicial letter number 548/2025, in the names Carmen sive Melina Borg vs Maria Theresa sive Marthese Falzon et , the following publication for the purpose of service on the respondent Maria Theresa sive Marthese Falzon and Carmel Falzon was ordered in terms of Article 187 (3) et sequitur of Cap. 12.

To Maria Theresa sive Marthese Falzon (ID 321760M) and Carmel Falzon (ID 190660M) 9, Pjazza Repubblika, Żurrieq

By means of the present Carmen sive Melina Borg (ID 27262M) of 114, Mater Alba, Triq il-Pont, Mellieħa, is referring to the premises with address 9/10, Pjazza Repubblika, Żurrieq. This premises is the property of the interpellant and the respondent Maria Theresa Falzon. However, this property is being abused by you despite the fact that you have alternative immovable properties where you go to live.

During these last years, the interpellant asked you several times to leave the property above referred to and this amongst others because the occupation of the same was prejudicial to income that the co-owners can prevail from the property in question in the form of rents.

Expert report by architect Mark Arrigo (here attached and marked Doc. MB1), it follows that during the last five years, the immovable property above mentioned was rented for an average of about €12,000 provided that the lease of the premises over a period of five years has a value of €56,925.04. Half of this sum, that is €28,462.62 would have been due to the interpellant.

The interpellant asked you how often you leave this premises, but you remained in default. Thus it follows that the interpellant should be entitled to compensation for your occupation of this premises for the last five years.

Thus, the interpellant is soliciting you so that within two days from the date of service of this judicial act you pay the sum of €28,462.62. Furthermore, a period of one month is being granted to vacate the above mentioned property as already requested so that this property is leased or sold in the interest of all the co-owners.

Failing to do this, judicial proceedings will be instituted against you without any other prior notice and with the filing of a garnishee order in order to safeguard the rights of the interpellant.

This judicial letter is being made for all effects and purposes of law.

So much so that you may regulate yourselves.

IT IS BEING NOTIFIED that by a decree dated 9th May, 2025, given by the Court of Magistrates (Malta) as a Court of Criminal Inquiry (Magistrate Dr Abigail Critien, LLD). Compilation Number 5935/2025, in the case:

NIKOLA STOJMANOVSKI, usher, 26 years, son of Viktor Stojmanovski and Natalija Stojmanovski née Ilijevska, born in Macedonia, on the 15th February, 1999, and residing at 151, Apt. 2, Greystone Crt, 15, Triq il-Klarissi, St Julian’s, and/or ‘Argos’, Triq it-Tamar, St Paul’s Bay, and holder of a Maltese identification document bearing number 343810A.

The Court ORDERED the attachment in the hands of third parties in general of all moneys and other movable property due to or pertaining or belonging to NIKOLA STOJMANOVSKI and prohibits the said accused from transferring, pledging, hypothecating or otherwise disposing of any movable or immovable property, and this in terms of Article 22A of the Dangerous Drugs Ordinance, Cap. 101 of the Laws of Malta, and Article 23A of the Criminal Code, Cap. 9 of the Laws of Malta.

The Court AUTHORISED the said accused to receive the amount of thirteen thousand, nine hundred and seventy-six euro and twenty-four cents (€13,976.24) per year, after the accused indicates by means of a note from where he is perceiving this money.

Any person who acts in contravention of the court order mentioned in Article 22A and Article 23A referred to above shall be guilty of an offence and shall on conviction be liable to a fine (multa) not exceeding eleven thousand, six hundred and forty-six euro and eighty-seven cents (€11,646.87), or to imprisonment for a period not exceeding twelve months, or to both such fine and imprisonment.

Any transfer or other disposal of any property made in contravention of the said Court order shall be null and without effect at law.

1. VARIATION OF SEIZING AND FREEZING ORDER

The Court ORDERED that the seizing and freezing order issued on 20th March, 2021, against the accused BRIAN TONNA, KARL CINI, BT INTERNATIONAL LIMITED, NEXIA BT LIMITED, NEXIA BT ADVISORY SERVICES LIMITED, BTI MANAGEMENT LIMITED, SPX SERVICES LIMITED, and WILLERBY TRADE INC. is being limited to:

Two million, one hundred and thirty-six thousand, nine hundred and eighty-seven euro (€2,136,987.00) with regards to the accused BRIAN TONNA;

Two hundred thousand euro (€200,000.00) with regards to the accused KARL CINI;

Eight hundred and ninety-four thousand, and five euro (€894,005.00) with regards to the accused BT INTERNATIONAL LIMITED;

Fourteen thousand, two hundred and forty-two euro and fifty cents (€14,242.50) with regards to the accused NEXIA BT LIMITED;

Eighty thousand euro (€80,000.00) with regards to the accused NEXIA BT ADVISORY SERVICES LIMITED;

One million, three hundred and sixty-one thousand, nine hundred and ninety-five euro (€1,361,995.00) with regards to the accused BTI MANAGEMENT LIMITED;

Seven hundred and twenty-one thousand, one hundred and twenty-one euro (€721,121.00) with regards to the accused SPX SERVICES LIMITED;

Seven hundred and fifty thousand, five hundred and two euro (€750,502.00) with regards to the accused WILLERBY TRADE INC.;

as the assets that shall be subject to confiscation in the case of a conviction. That the other property of the accused shall not be considered as being subject to the seizing and freezing order.

2. TEMPORARY SEIZING AND FREEZING ORDER

The Court ORDERED the temporary attachment of any property in the hands of third parties for which there is reasonable cause to believe that the property is subject to confiscation, and is restraining and prohibiting the accused BRIAN TONNA and SPX SERVICES LIMITED from transferring, pledging, hypothecating, or otherwise changing or disposing of any such property and of such other property owned by them or being in their possession up to the limit of:

One hundred thousand euro (€100,000.00) with regards to the accused BRIAN TONNA;

Twenty-two thousand euro (€22,000.00) with regards to the accused SPX SERVICES LIMITED;

and this in terms of Article 36 (8)(i) of the Proceeds of Crime Act, Cap. 621 of the Laws of Malta.

This notification is being published in terms of Article 36 (4)(a) and Article 36 (8)(i) of the Proceeds of Crime Act, Cap. 621 of the Laws of Malta, following a seizing and freezing order which decree was given by the Court of Magistrates (Malta) as a Court of Criminal Inquiry (Magistrate Dr Charmaine Galea, LLD) on the 20th March, 2021, which was published in the Government Gazette on the 26th March, 2021, where the court ordered the attachment in the hands of third parties in general of all moneys and other movable or immovable property due or pertaining or belonging to BRIAN TONNA, Manuel (Emmanuel) Castagna, KARL CINI, Marie Katrin Bondin Carter, KBT Holdings Limited, BT INTERNATIONAL LIMITED, NEXIA BT LIMITED, NEXIA BT ADVISORY SERVICES LIMITED, BTI MANAGEMENT LIMITED, SPX SERVICES LIMITED, and WILLERBY TRADE INC.

STEPHEN DOWNES, fishmonger, 22 years, son of David James Downes and Antoinette Downes née Said, born in Tal-Pietà, Malta, on the 6th May, 2003, and residing at ‘Ezekiel’, Block A, Flat 5, Triq Patri Wistin Born, Marsaskala, and holder of a Maltese identity card bearing number 163403L.

The Court ORDERED the attachment in the hands of third parties in general of all moneys and other movable property due to or pertaining or belonging to STOYAN GAFÀ and STEPHEN DOWNES and prohibits the said accused from transferring, pledging, hypothecating or otherwise disposing of any movable or immovable property, and this in terms of Article 22A of the Dangerous Drugs Ordinance, Cap. 101 of the Laws of Malta.

The Court AUTHORISED the said accused to receive the amount of thirteen thousand, nine hundred and seventy-six euro (€13,976.00) per year, from which it shall be specified what moneys may be paid or received by the accused during the existence of this order, including the source, method and other modalities of payments including salary, wages, pension and/or social security benefits.

Any person who acts in contravention of the court order as mentioned in Article 22A referred to above shall be guilty of an offence and shall on conviction be liable to a fine (multa) not exceeding eleven thousand and six hundred and forty-six euro and eighty-seven cents (€11,646.87), or to imprisonment for a period not exceeding twelve months, or to both such fine and imprisonment.

Any transfer or other disposal of any property made in contravention of the said Court order shall be null and without effect at law.
