It is hereby notified that by a decree given on the 12th February, 2026, the Court of Magistrates (Gozo), Superior Jurisdiction, General Section, ordered the publication of the extract reproduced below in terms of article 931 (3) of the Code of Organisation and Civil Procedure.

By a decree given on the 12th February, 2026, it was ordered that a deputy curator be chosen according to the law to represent the direct owners/successors in title who today are unknown persons for the concession of the ground rent entitled to receive the said ground rent and namely the persons entitled to receive of the annual and perpetual ground rent of the immovable property described hereunder in the schedule of deposit and redemption of ground rent bearing number 408/2025 FG in names Eden Marie Galea vs Deputy Curator to represent the direct owners/successors in title who today are unknown persons for the concession of the ground rent entitled to receive the said ground rent, and namely the persons entitled to receive of the annual and perpetual ground rent of the immovable property described hereunder, which schedule of deposit was filed on the 14th November, 2025, in the Court of Magistrates (Gozo) Superior Jurisdiction, General Section, and in all other relative and subsequent acts.

The immovable property subject to this schedule is:

A portion of land suitable for development, with an unnumbered and unnamed room within it, with all its airspace and relative subsoil, in the district known as ‘Ta’ Ħida’, in Triq Tad-Duru, Nadur, Gozo, measuring approximately four hundred and ninety seven square metres (497 sq.m.). The same property is bounded on the East by Triq tad-Duru, on the North by property of the heirs of the Sammut family, and on the South and Southwest by property of Peter Mifsud or more correct boundaries. The same property is better shown on the site plan attached with the same schedule and marked as Doc. A, and which property is possibly subject to the equivalent today of fifty four euro cents (€0.54c) annual and perpetual ground rent, and which ground rent the applicant wishes to redeem in terms of Article 1501 of the Civil Code, and which amount capitalized at the rate of 5% amounts to ten euro and eighty cents (€10.80c), which together with the payment of two euro and seventy cents (€2.70c) for the last five years arrears of ground rent as well as the sum of fifty four euro cents (€0.54c) as laudemium due, amount to a total of fourteen euro and four cents (€14.04c), which is being deposited so that anyone entitled to it can freely withdraw it after tendering due receipt.

You, executive officer of the Court of Magistrates (Gozo) are therefore ordered to affix an official copy of this notice at the entrance of this Court and thereby summon anyone who wants to enter as a curator to appear within a period of six (6) days in this Registry and make a note declaring that they so accept.

You are also ordered to inform one and all that if they do not make this declaration within the time given above, this Court will proceed to choose a curator of the office. And after you have done this, or if you encounter any obstacle in the execution of this order, you should inform this Court.

By a Decree of the 15th May, 2025, given by the First Hall Civil Court, the Court ordered that the extract hereunder mentioned be published for the purpose of service according the Article 338 (1) of the Code of Organisation and Civil Procedure (Cap. 12).

That by application and a Schedule of set-off filed contemporaneously by Bank of Valletta plc with the registration number C2833 on the 12th May, 2025, the approval of the said judicial acts is being demanded for the amount of €83,400 following judicial sale by auction 44/21 in the names Bank of Valletta plc C2833 vs John Tanti ID 375982M and Odette Sammut (ID 3199189M) held under the Authority of the said Court on the 6th May, 2025.

According to Article 338 (2) of Cap. 12: Any person who may have an interest and the persons so served shall be allowed the time of twenty days to file an answer stating in detail the reasons for their opposition and the amounts in contestation; and where such opposition is based on a claim against the proceeds of sale an alleged cause of preference, they are to state the amount of such claim and the basis for the preference. Such persons shall with the answer file all relevant evidence to substantiate their opposition.

By virtue of a decree issued on the 12th of February, 2026, it was ordered that a deputy curator be chosen according to law to represent the absentees, since they live abroad, Timothy Peter Kane and Lorraine Carmen sive Lorraine Kane in the records of the judicial letter a summary of which is being produced hereunder, which letter bears the number 867/2025 FG in the names ‘John Grech versus Deputy Curator to represent the absentees, since they live abroad: Timothy Peter Kane (née Kane) British passport holder bearing number GBR 132596521; And Lorraine Carmen sive Lorraine Kane (née Kane) holder of British Passport bearing number GBR 127173099’ filed on the 23rd December, 2025, in the Court of Magistrates (Gozo) Superior Jurisdiction, General Section, and in all other relative and subsequent acts.

By means of this judicial letter the interpellant is calling upon the said respondents Timothy Peter Kane and Lorraine Carmen sive Lorraine Kane so that within one week they refund and pay back to the interpellant the sum of fifteen thousand euro (€15,000), and this in so far as the said payment was made to them improperly and without a just cause, since they had never paid the original sale price and this regarding a contract of sale and subsequent contract of termination, all in the records of Notary Dr Maria Vella Magro, dated nineteenth April of the year two thousand and eighteen and twenty three of September of the year two thousand and twenty five, respectively. When the sale was made by the interpellant they did not pay the interpellant the amount due to him, and this in the amount of fifteen thousand euro (€15,000). When the rescission was made, the interpellant ended up being constrained to pass on to them a sum which they had never passed on to him, and thus this payment had been made unduly.

You are therefore ordered to affix an official copy of this notice at the entrance of this Court and thereby summon anyone who wants to be appointed as curator to appear within six (6) days in this Registry and make a note declaring so.

That the applicants wish to avail themselves of the faculty granted to them by article 1501 of the Civil Code and redeem this comprehensive sub-emphyteusis of thirteen euro and twenty-four cents (€13.24c) which capitalized at five per cent amounts to two hundred and sixty-four euro and eighty cents (€264.80c);

That in order to exempt themselves from any liability, the applicants are also depositing thirty (30) years’ rent, amounting to three hundred and ninety-seven euro and twenty cents (€397.20c).

The applicants declare that they are thereby redeeming all sub-emphyteusis imposed on the territory subject to the sub-emphyteusis even if the area of that territory greatly exceeds the area of the land owned by them, so that they would have ċertainly redeemed any sub-emphyteusis that may have been due on their lands, and this without prejudice to the rights of the owners of the remaining area of that granted.

The applicants are therefore appealing to this Honourable Court and under its authority deposit the total sum of six hundred and sixty-two euro (€662) in redemption of rent and arrears of rent as indicated above, from which sum, the amount of seventy-two euro (€72) may be freely withdrawn by the respondent deputy curator to represent the heirs of the above-mentioned Vella brothers and the balance of five hundred and ninety euro (€590) to the deputy curator to represent the heirs of Giusepp Grech and this after tendering due receipt according to law.

You are hereby ordered to affix an official copy of this banns at the entrance of this Court and hereby summons every person who wishes to be appointed as a curator to appear within six (6) days in this Registry and make a declaration by note that he so wishes.
