Whereas the applicants are the owners of the commercial premises with official number 14 (previously number 19) in Triq San Ġużepp, Victoria, Gozo;

Whereas the said premises are subject to a controlled lease which commenced long before the year 1995, and the premises are currently being used as a shop by John Bezzina, who is the nephew of the original tenant Emidio Bezzina;

Whereas the rent was originally eleven Maltese lira annually (equivalent to €25.62 annually) and following the amendments to the Civil Code which were introduced by virtue of Act X of 2009 the rent gradually increased in accordance with the law;

Whereas the last rent collected was that for the year 2025 which was in the meagre amount of €80.41 for a full year, as results from the attached copy of a receipt marked Document ‘A’;

Whereas the current rent is truly outrageous, especially when compared to the rental value that the property is capable of fetching today on the open market, as is evident from the attached expert report marked Document ‘B’;

Whereas it therefore results very clearly that the applicants are suffering, and have been suffering for a long time, an infringement of their fundamental rights due to the fact that they did not have and do not have control of their property and must necessarily succumb to this forced tenancy where the premises were and still are occupied at a meagre rent;

Furthermore, although the amendments introduced by Act X of 2009 introduced an increase in rent, clearly in the present case this did not make any noticeable difference. in the adequacy of the amount of rent, given that the original rent was so low that the rent has still not even reached the minimum of €185 per year that was established for residential properties;

Furthermore, although the amendments introduced by Act X of 2009 stipulate that in 2028 the lease will no longer be renewed, to this day the applicants are still obliged to renew the lease and are still deprived of effective control of their property, and the situation has been like this since long before 1987;

Whereas this property was originally the property of Ursola Said who died on 22nd December, 1971, and who left a will dated 19th March, 1964, in the acts of Notary Dr Antonio Galea by which she bequeathed the said property to Joseph Scicluna, subject to usufruct in favour of her sister Assunta Bezzina née Said;

Whereas by a contract dated 8th March, 1972 (Document ‘C’) in the records of Notary Antonio Galea the said Joseph Scicluna assigned to his sister Rose Saliba, the applicant herein, the undivided half of the same shop, always subject to the usufruct vita natura durante of Assunta Bezzina;

Whereas, with effect from 8th March, 1972, ownership of the property vested in Joseph Scicluna and Rose Saliba, each holding an undivided one-half share;

Whereas Assunta Bezzina died on the nineteenth (19th) of May, 1977, and therefore the usufruct she enjoyed ended;

Whereas Joseph Scicluna passed away on the twenty-fifth (25th) of April, 1989, and by a unica charta will published in the acts of Notary Doctor Michael Refalo on the eighteenth (18th) of March, 1986, together with his wife Dolores Scicluna, the Scicluna spouses mutually left the use and usufruct of all their assets, while nominating their four children Eugenia Saliba, Geraldine Vella, Antonia sive Ninette Grech and Mary sive Miriam Portelli as their universal heirs in equal shares between them;

Whereas Dolores Scicluna passed away on the seventeenth (17th) of August, 2021, and therefore the usufruct she enjoyed has ended;

Whereas thus today the property is owned by Rose Saliba in an undivided half share, while Eugenia Saliba, Geraldine Vella, Ninette Grech and Mary sive Miriam Portelli each have an undivided eighth share;

Whereas therefore for a considerable period of time the applicants and their ante causa have been deprived of receiving a fair and reasonable rent for the use of the said commercial premises;

Whereas therefore the application of the rent laws against the applicants and their ante causa gave a considerable advantage to the tenants by removing from the hands of the owners the right to effectively negotiate an appropriate rent as compensation due for the enjoyment of the premises owned by the applicants, and forced the applicants to submit to the imposition of the renewal of the rent with payment of a consideration much lower than what was supposed to be due to them according to market conditions;

Whereas in this way the applicants, including their ante causa by the previous owners, were deprived of the enjoyment of their property without being given adequate compensation for taking possession of the property in question;

Whereas therefore the applicants feel that their fundamental rights to the free enjoyment of their property as protected by Article 1 of the First Protocol to the European Convention on Human Rights have been violated in their case;

Therefore, the applicants respectfully request that this Honourable Court be pleased to, without prejudice to any other appropriate and opportune declaration:

1. Declare that by the facts as stated and by the continued occupation of the commercial premises with official number 14 (previously number 19) in Triq San Ġużepp, Victoria, Gozo, without the payment of adequate compensation reflecting the market value and by the application of the laws which allowed the renewal of the lease of the same premises, violated the fundamental rights of the applicants (including for the time when the property belonged to them ante causa) as protected in Article 1 of the First Protocol to the European Convention on Human Rights (First Schedule to Cap. 319);

2. Liquidate and award all appropriate compensation due in favour of the applicants for the entire period during which the aforementioned premises were occupied in violation of their rights and their ante causa as aforesaid, both moral and pecuniary, and for any ancillary loss suffered by them, and order the respondents to pay the same compensation to the applicants;

3. Grant the applicants any other appropriate or opportune order and remedy to remedy the violation of their fundamental rights complained of herein.

By means of an application filed in the Civil Court of Voluntary Jurisdiction Section, on the 26th March, 2026, Application number 299/2026, by Grezzja sive Grace Muscat et, whereby they requested that it be declared open in favour of Grezzja sive Grace Muscat, wife of the decujus, in the quota of one half (1/2) undivided and the remaining one half (1/2) undivided share in favour of Joseph Muscat son of the decujus the succession of Salvu sive Saviour Muscat, husband of Grezzja sive Grace Muscat née Borg, son of the late Joseph Muscat and Maria Lourdes née Falzon, born in Lija, Malta, resided in St Paul’s Bay, Malta, and died in Msida, Malta, on the 3rd June, 2024, aged 78, and who held identity card number 620545M.

Wherefore, any person who believes to have an interest in the matter is hereby called upon to appear before the said Court and to bring forward his objections hereto by a minute to be filed within fifteen days from the posting of the banns and notices according to law.

IT IS BEING NOTIFIED that by a decree dated 27th April, 2026, given by the Criminal Court (the Hon. Judge Dr Natasha Galea Sciberras, LLD), in the case:

SAGE GAUCI, 27 years, car wash attendant, son of Ersilia née Gauci, born in Pietà, Malta on the 23rd of April, 1999, residing at 46, Fl 5, Triq Marsamxett, Valletta, and holder of Maltese identity card bearing number 141699M. 

The Court ORDERED THE CANCELLATION and the revocation contrario imperio of the Freezing Order issued on the assets of SAGE GAUCI which order was given by the Court of Magistrates (Malta) as a Court of Criminal Inquiry (Magistrate Dr Josette Demicoli, LLD) by a decree dated 31st October, 2018, which was duly published in the Government Gazette of the 6th November, 2018, and declared that the said order is no longer in force.

IT IS BEING NOTIFIED that by a decree dated 26th April, 2026, given by the Court of Magistrates (Malta) as a Court of Criminal Judicature (Magistrate Dr Marse-Anne Farrugia, LLD). Compilation Number 2778/2026, in the case: 
 
The Republic of Malta 
 
Versus 
 
CLAUDIO MALLIA, 44 years, son of Anthony Mallia and Rita Mallia née Cuschieri, born in Tal-Pietà, Malta, on the 8th October 1981, and residing at Bieb A, Flat 7, Triq Sant’Orsola, Valletta, Malta, and holder of Maltese identity card, bearing number 557681M.

The Court is ordering a ‘Seizure and Freezing Order’ and is generally sequestering, in the hands of third parties, all monies and movable property that are owed to and/or belong to CLAUDIO MALLIA or are his property, and is prohibiting the accused from transferring, pledging, mortgaging, or otherwise disposing of any movable or immovable property, in accordance with Article 22A of the Dangerous Drugs Ordinance, Cap. 101 of the Laws of Malta.

Any person who acts in contravention of the Court order mentioned in Article 22A referred to above shall be guilty of an offence and shall on conviction be liable to a fine (multa) not exceeding eleven thousand, six hundred and forty-six euro and eighty-seven cents (€11,646.87), or to imprisonment for a period not exceeding twelve months, or to both such fine and imprisonment.

Any transfer or other disposal of any property made in contravention of the said Court order shall be null and without effect at law.
