ACQUISITION OF LAND

 

Declaration by the LANDS AUTHORITY

 

This declaration is amending Government Notice No. 1253 published in Government Gazette No. 20,508 of the 28th October, 2020 and is also substituting Government Notice No. 334 published in Government Gazette No. 20,587 of the 11th March, 2021. This declaration is being issued as ordered by the Lands Arbitration Board by means of two provisions given on the 5th March, 2021 and on the 23rd April, 2021 (Application 55/2020SG).

 

Whereas by the Declaration of the President of Malta of the 28th April, 1989, the undermentioned land was declared to be required by the competent Authority for a public purpose in accordance with the Land Acquisition (Public Purposes) Ordinance (Cap. 88) and that its acquisition thereof was by absolute purchase.

 

Today I hereby declare that the undermentioned land is still required by the Government of Malta for a public purpose in accordance with the Government Lands Act (Chapter 573) of the Laws of Malta and that its acquisition thereof is to be by absolute purchase.

Description of the Land

 

The following land at Valletta:

1. The premises No. 39 (already 28), in Triq id-Dejqa.

 

2. The premises No. 40 (already 29), in Triq id-Dejqa.

 

3. The premises No. 41 (already 30), in Triq id-Dejqa.

 

4. The premises No. 42 (already 31), in Triq id-Dejqa.

 

The above-mentioned premises are being acquired due to the extension of the Courts Building.

 

The above mentioned premises are shown with numbers 28,29,30 and 31 respectively in the declaration by the president of Malta of the 28th April, 1989 and are shown with the colour red and marked with numbers 28,29,30 and 31 respectively on plan L.D. no. 73/89 (which premises today have the numbers 39, 40, 41 and 42 respectively as indicated above), which may be viewed on demand at the Lands Authority, Auberge de Baviere, Valletta.

 

That this declaration is being issued for the purposes of Article 44 of Chapter 573.

 

The compensation offered for the above mentioned premises in terms of Article 44 and 64 of Chapter 573 is five hundred and ninety six thousand, two hundred and thirty nine Euros and ninety three cents (€596,239.93), according to the valuation made by Architects Joseph Saliba, Valeriano Schembri and Melaine Spiteri, an extract of which is being attached with this declaration.

 

A site plan showing the mentioned immovable property is being published with this declaration.

Ministry for Finance and Employment

 

A Once-Only Grant for Persons who before Officially joining the Public Service after 16th January, 1979 had served in Government Departments but not as Public Officers

 

IN ORDER to implement one of the measures identified in Budget 2021, the Prime Minister, the Minister for Finance and Employment and the Minister for the Social Justice and Solidarity, the Family and Children's Rights have developed the following Scheme that aims to provide a once-only grant for persons who before officially joining the public service after 16th January 1979 had served in Government departments but not as public officers.

 

SCHEME

 

1. Interpretation

 

In this Scheme, unless the context otherwise requires:

 

“Malta" means the Maltese Islands;

 

“applicant/s" means citizen/s of Malta who before officially joining the public service after 16th January 1979 had served in Government departments but not as public officers;

 

“public office" means an office of emolument in the public service;

 

“public officer" means the holder of any public office or of a person appointed to act in such an office;

 

“qualifying period" means the uninterrupted period during which applicant served in the public service not as a public officer in any time starting before 16th January 1979 and ending immediately on the first official appointment as public officer after 16th January 1979;

 

“effective period" means the period between the date when applicant officially joined the public service and his/her date of retirement from same public service.

 

2. Area of applicability

 

This Scheme applies to the period of time applicants served in the public service during the effective period, immediately after the end of the qualifying period. The applicant shall only be entitled to a once-only grant in respect of the service rendered during the effective period. 

 

The Scheme applies to applicants who served in Government departments not as public officers during the qualifying period, and who immediately following the termination of such qualifying period served in the public service.

 

The Scheme also applies to the heirs of such individuals if they satisfy the conditions of this Scheme and if they are deceased when the application for the grant under the Scheme is made.   

 

The Scheme does not apply to individuals who are in receipt of, or have a right to receive, a pension under the Pensions Ordinance (Chapter 93), the Police Act (Chapter 164) or the Malta Armed Forces Act (Chapter 220).

 

3. Manner of application and supporting documents

 

(i) New applications under this Scheme shall be made on the application form set out in the Schedule to this Scheme and shall contain all the information and details as required in the said form and in terms of this Scheme.

 

(ii) In the case of applications under this Scheme made by the heirs of the same decujus, the application shall be made by the heirs. Where there is more than one heir, there shall be made one joint application by the heirs. Together with the application, there shall be produced a declaration made by a notary public, in which declaration there shall be declared who the heir or heirs of the decujus is or are, and who is the sole heir authorized to receive payment on behalf of all heirs, on condition that the decujus was eligible to apply for the Scheme. The Department reserves the right to request the production of other documents besides the document herein mentioned. 

  

(iii) Only those applications that are found to conform with the provisions of this Scheme shall be eligible for payment of the grant.

 

(iv) Persons who applied and were eligible under the Schemes issued in the Government Gazette of 2nd May 2017, 17th April 2018, 26th April 2019 and 8th May 2020 and are still eligible to receive payment under the same Schemes need not re-apply under this new Scheme. The Department of Social Security will process payments on the basis of available details.

 

(v) However, in the case of the demise of an eligible applicant or authorized heir who received payment under the previous calls for applications, a fresh application under this new call has to be submitted by the heirs in the manner explained in sub-clause 3 (ii) above.

 

(vi) Eligible persons who retired in 2020 and failed to apply under the scheme published on 8th May 2020, as well as eligible persons who are due to reach retirement age in 2021 can apply under the new Scheme.

 

(vii) Applications under this Scheme, including the documents that are to be attached to the application, shall be sent by mail to the Department of Social Security in Malta, at 38, Triq l-Ordinanza, Valletta, VLT 1021, or by email on (social.security@gov.mt) by 31st July, 2021. 4. Grant payable under this Scheme

 

Applicants who are eligible according to the qualifying period, including heirs where applicable, may apply for a grant in respect of the service rendered during the effective period. 

 

5. Payment of Grant

 

The amount of the grant will be paid to the eligible applicant either by direct credit in the bank account of the eligible beneficiary as known to the Department of Social Security, acting on instructions of same beneficiaries, or by cheque. Cheques shall be posted to the address shown on the application form. No interests shall run on the amount of the grant due to the applicant.

 

It is a condition of this Scheme that by accepting the grant, the applicant shall be renouncing to any other future claim related to this Scheme and shall withdraw any case presently instituted against Government, Authority or Government entity. Plaintiffs, or their authorised heirs, in each case or cases have to present a sworn declaration in the Registry of the Superior Courts to renounce and withdraw the case or cases. Proof of such renunciation and withdrawal must be presented together with the application, as explained on same application form.

 

The Scheme may be spread over a number of years with separate calls for application being issued from time to time. Each call for applications shall be subject to a separate verification process. The details shall be announced with each call which may be issued.

 

6. Validity of application

 

An application shall not be deemed to have been submitted unless it is full and complete in all material respects and unless it contains all the information and is accompanied by all the documentation requested therein.

 

7. Review of decisions

 

An applicant whose application for the payment of the grant under the Scheme is not acceded to shall be informed by the Department of Social Security of such refusal by means of a letter.

 

An applicant who feels aggrieved from the decision taken, has the right to request a revision of the said decision within twenty-one (21) days from the receipt of the decision. The request for a revision, together with a copy of the refusal letter, shall be sent within the established period by means of a registered letter addressed to the Secretary, Grant Review Board, 38, Triq l-Ordinanza, Valletta, VLT 1021.

 

 

The review of the decision shall be done by the Grant Review Board which Board shall be set up following an order issued by the Minister responsible for Finance and Employment and published in the Government Gazette. The decision of the Grant Review Board shall be final and there shall be no appeal from the decision of the Board.

 

8. Amendments to the Scheme

 

The Minister responsible for Finance and Employment shall have the right to make any amendments to this Scheme by the publication of the said amendments in the Government Gazette.

(a) were employed by corporations or entities in the public sector on their discharge from one of the labour corps established before 1979; or

 

(b) were employed in the Gas Board until its dissolution and afterwards were employed by Enemalta Corporation; or

 

(c) were apprentices in the Malta Electricity Board until its dissolution and afterwards were employed by Enemalta Corporation.

 

SCHEME

 

1. Interpretation

 

In this Scheme, unless the context otherwise requires:

 

“Malta" means the Maltese Islands;

 

“applicant/s" means citizen/s of Malta who:

 

(a) was/were employed by corporations or entities in the public sector on discharge from one of the labour corps established before 1979; or

 

(b) was/were employed in the Gas Board until its dissolution and afterwards was/were employed by Enemalta Corporation; or

 

(c) was/were apprentices in the Malta Electricity Board until its dissolution and afterwards was/were employed by Enemalta Corporation.

 

“effective period" means the period between 16th January 1979, or the date of the official appointment of an applicant with a corporation or entity in the public sector if such date is after the above-mentioned date, and the date when such applicant terminated his employment in the public sector.

 

2. Area of applicability

 

This Scheme applies to the period of time applicants served in the public sector during the effective period. The applicant shall only be entitled to a once-only grant in respect of the service rendered during the effective period. 

 

The Scheme applies to citizens of Malta as defined in section (1) above.

 

The Scheme also applies to the heirs of such individuals if they satisfy the conditions of this Scheme.   

 

The Scheme does not apply to individuals who are in receipt of, or have a right to receive, a pension under the Pensions Ordinance (Chapter 93), the Police Act (Chapter 164) or the Malta Armed Forces Act (Chapter 220) or any other service pension.

A Once-Only Grant for Persons who were formerly Licensed Port Workers between 4th April, 1973 and 1st June, 2007 and who were not so Licensed after such period 

 

IN ORDER to implement one of the measures identified in Budget for the year 2021, the Prime Minister, the Minister for Finance and Employment and the Minister for Transport, Infrastructure and Capital Projects, have developed the following Scheme that aims to provide a once only grant for persons who were formerly employed as licensed port workers between 4th April, 1973 and 1st June, 2007 and who were not so licensed after such period.

 

SCHEME

 

1. Interpretation

 

In this Scheme, unless the context otherwise requires:

 

“Malta" means the Maltese Islands;

 

“applicant/s" means an individual resident in Malta who was formerly employed as a licensed port worker between 4th April, 1973 and 1st June, 2007 and was not so licensed after this period.

 

“effective period" means the period between 4th April 1973 and 1st June 2007.

 

2. Area of applicability

 

This Scheme applies to applicants enrolled in the Port Pension and Contingency Fund during the effective period. Applicants so enrolled shall only be entitled to a once only grant.

 

The Scheme also applies to the heirs of such port workers if such port workers are deceased when the application for the once only grant under the Scheme is made.   

 

3. Manner of application and supporting documents

 

(i) Applications under this Scheme shall be made on the application form set out in the Schedule to this Scheme and shall contain all the information and details as required in the said form and in terms of this Scheme.

(ii)  In the case of applications under this Scheme made by the heirs of the same decujus, the application shall be made by the heirs. Where there is more than one heir, there shall be made one joint application by the heirs. Together with the application, there shall be produced a declaration made by a notary public, in which declaration there shall be declared who the heir or heirs of the decujus is or are, and who is the sole heir authorized to receive payment on behalf of all heirs, on condition that the decujus was eligible to apply for the Scheme. The Ministry for Transport, Infrastructure and Capital Projects reserves the right to request the production of other documents besides the documents herein mentioned.

 

(iii) Only those applications that are found to conform with the provisions of this Scheme shall be eligible for payment of the grant.

 

(iv) Applications under this Scheme, including the documents that are to be attached to the application, shall be sent by mail to the Ministry for Transport, Infrastructure and Capital Projects, Block A, Francesco Buonamici Street, Floriana FRN 1700 by not later than 31st July, 2021.

 

(v) Persons who had applied under the Scheme issued in the Government Gazette on 2nd May 2017, 17th April 2018, 26th April 2019 and on 8th May 2020 and who later received payments in view of their eligibility under that same Scheme, will be contacted by the Ministry for Transport, Infrastructure and Capital Projects in due course, to confirm the relevant details.

 

(vi) In the case of the demise of an eligible applicant or authorized heir who received payment under the previous calls for applications in 2017 / 2018 / 2019 /2020, a fresh application under this new call has to be submitted by the heirs in the manner explained in sub-clause 3 (ii) above.

 

4. Grant payable under this scheme

 

Eligible applicants who were members in the Port and Contingency Fund during the effective period, including their heirs where applicable, may apply for a once-only grant

 

5. Payment of Grant

 

The amount of the grant will be paid to the eligible applicant by cheque or via a direct credit transaction in his/her Bank Account. In the case of cheques, these shall be posted to the address shown on the application form. No interest shall run on the amount of the grant due to the applicant.

Any person may, within one month from the publication of this notice, object in writing to the Commissioner about the issue of the above licences on any of the grounds listed in section 10 of the Private Guards and Community Officers  Act 1996, which are:

 

(a) where the applicant or any officer of the applicant or any person who has an effective control of the services to be provided by the applicant.

 

(i) has been convicted in Malta or elsewhere of any crime against the safety of the state, or of any crime of voluntary harm or injury to any person or any crime against property or public trust or any other serious crime; or

 

(ii) has been declared bankrupt or his financial position is precarious or otherwise renders the applicant unsuitable; or

 

 

(iii) has been discharged from the police or armed forces or the prison services because of any offence or other misbehaviour; or

 

(iv) is a public officer or a member of the police or armed forces or the prison services; or

 

(b) when information is available which is in the public interest; or

 

(c) where the applicant does not possess the necessary qualifications as may be prescribed by or under the Act.

Completion of Road Formation and Traffic and Parking Suspension

 

In virtue of Article eighteen (18) of Legal Notice 291 of 2018, the Agency for Infrastructure Malta hereby gives official notice of its intention to complete the formation of:

 

Triq taż-Żebbiegħ, Ħaż Żebbuġ (indicated on the site plan on page 4024).

Triq il-Familja Brancati, Mqabba (indicated on the site plan on page 4025).

New streets in Triq Dun Ġwann Theuma/Triq Dun Mikiel Xerri, Ħ'Attard (indicated on the site plan on page 4026).

Triq Profs David H. Trump, Mġarr (indicated on the site plan on page 4027).

Triq Gio C. Dei Marchesi Mallia Tabone, Mosta (indicated on the site plan on page 4028).

 

Any person who is obliged by law to form said road (including by acquiring land necessary for the same formation) has fifteen (15) days from the date of the publication of this notice within which to comply with his obligations at law. In default, the Agency for Infrastructure Malta shall itself proceed with the formation of this road in accordance with its powers at law and at the expense of those persons whose obligation it is to form the road.
