Delegation of Authority – Agricultural Act (Cap. 639)

The Director of Agriculture hereby notifies the delegation of authority to Ms Sonya Sammut as Director of Food Systems within the Ministry for Agriculture, Fisheries and Animal Rights, as per the definition of 'director' within the context of the Agricultural Act (Cap. 639), to act on his behalf for the purposes of conducting controls under Subsidiary Legislation 639.11 titled Primary Production of Food of Non-animal Origin (Including Sprouts Production) Regulations.

EMERGENCY CONSERVATION ORDER

Section 58 of the Development Planning Act 2016

The Planning Authority considers that the following property:

Tal-Latnija Cave, l/o Mellieħa

(see site plan on page 5050) is of archaeological value such that it should be listed as a Scheduled Property in terms of Article 57 of the Development Planning Act 2016.

The Planning Authority feels that this property is to be considered as “heritage at risk".  Within this context, this term refers to those sites and cultural landscapes that are more at risk of being lost or damaged as a result of illegal access.  The loss or partial loss of the site, cultural landscape or archaeological remains will result in the irreversible loss of cultural heritage.  Thus, the Planning Authority is hereby issuing an Emergency Conservation Order (ECO) in respect of the above site in accordance with Article 58 of the Development Planning Act 2016.  The scheduling of this property has not been concluded and therefore it is deemed essential that an ECO be published until the scheduling is concluded.

(i) The property is to be considered as a Class A scheduled property in terms of Article 57 of the Development Planning Act, 2016, and according to paragraph 2.27 and 2.28, and policies TO7, TO8, RO4 of the Strategic Plan for the Environment and Development (SPED) as well as NW Local Plan policy NWCO 4 by virtue of the site's archaeological importance.

(ii) Damage, demolition, development, dumping, soil disturbance, pillaging or movement of earth or removal of stones and remains, excavations, or alterations, within the cave or within the surrounding sensitive area is prohibited.

(iii) All uses within the aforementioned property are prohibited owing to the rich archaeological deposits potentially still in situ.

(iv) All archaeological interventions which might be permissible must have clearance from the Superintendent of Cultural Heritage.

(v) Since the site lies within an open setting devoid of any security facilities, the Superintendent of Cultural Heritage will be installing a perimeter security fence around the site.

(vi) Notwithstanding, prior to the installation of the fence, clearance from the Lands Authority and from the Environment and Resources Authority (ERA) is to be obtained.

(vii) The fence must respect the following criteria:

a. Scope – to secure site and control access;

b. Method of anchoring – if method to be used includes drilling of holes to install metal poles, care must be taken to minimise impact;

c. Height – preferably does not exceed circa 2m;

d. Material to be used – metal poles and metal mesh-grille fencing;

e. Pole frequency – circa 3m apart

f. Access – a gate to be installed within the fence.

The Order shall have effect for a period of 12 months from the date of publication of this order.  In accordance with Section 58 (4) of the Act, any appeal to the Tribunal from this Emergency Conservation Order shall not stay the execution of such order.

All restoration works and interventions have to follow respective criteria established by the Council of Europe and UNESCO in their Conventions, Charters and Protocols, to which Malta is signatory.

If the property is further damaged, altered, demolished or destroyed in contravention of this Order, the Authority will exercise its powers of enforcement as set out in the Development Planning Act, 2016. The Act provides for severe penalties for contraventions on Scheduled Property.

REGULATOR FOR ENERGY AND WATER SERVICES

A Grant for the Purchase of Water Heating Equipment

In order to further encourage the use of renewable sources of energy in the domestic sector, the Regulator for Energy and Water Services is administering the following national funded scheme which aims to encourage the use of Water Heating Equipment by renewable means.

1. Grant payable under this scheme

Applicants may apply for a grant under this scheme by means of an online form from the Regulator for Energy and Water Services website (www.rews.org.mt) or by means of the form downloadable from the same website. The scheme is administered and governed in terms of the guidelines also downloadable from the website.

Beneficiaries of Solar Water Heater schemes before the 2021, and also beneficiaries that opt for a non-stainless steel tank system post 2021, shall be eligible to apply for a second grant, after 5 years from the payment date of the original grant however only if they opt for the amended scheme of installing a stainless steel tank system.  Beneficiaries who opt post 2020 for stainless steel tanks shall automatically be eligible for a second grant after 10 years following payment of the first grant.

2. Duration of the scheme

Applications for this call may be validly received as from the 11th April 2025 until the end of the year. The scheme may be modified or terminated before that date by means of a notice in the Gazette. This scheme may be renewed as may be deemed necessary by the Regulator for Energy and Water Services also by means of a notice in the Gazette.

3. Amendments to the scheme

The Regulator for Energy and Water Services shall at all times have the right to make any amendments to this scheme by means of a notice published in the Gazette containing such amendments.

SCHEDULE

Grant Percentage and maximum:

Option A: 50% of the costs of the boiler plus panels themselves, including VAT, and capped at €700.

Option B: 75% of the costs of the Solar Water Heater itself, including VAT, and capped at €1,400. An additional grant of €500 will be provided after 5 years to cover the maintenance costs against a receipt issued by the supplier.

Option C: 50% of the costs of the Heat Pump Water Heater itself, including VAT, and capped at €1,400.
