MINISTRY FOR FINANCE

Regulations for the Fiscal Receipts Lottery

Conditions regulating the Lottery

(a) The Lottery shall be drawn twice a month and shall include fiscal receipts issued by means of fiscal cash registers or by means of other devices connected to a computer system approved by the Commissioner for Tax and Customs, and fiscal receipts issued manually.

(b) Only original receipts which contain the information specified in the Value Added Tax Act, Cap. 406 of the Laws of Malta and regulations made under that Act shall be eligible to participate in the draws. Any other receipts shall be considered invalid if drawn.

(c) The draws shall be held on the fifteenth (15) day and the twenty third (23) day of each month. If the fifteenth day and/or twenty third day of the month fall on a Saturday, a Sunday or a Public Holiday, the draws shall be held on the first following working day. The date and place of the draws shall be established by the officer in charge of Fiscal Receipts Lottery from time to time.

(d) The receipts received in a given month shall be divided in two lots. Receipts received at the Fiscal Receipts Lottery Unit up to 14:00hrs of the 5th day of the month shall be drawn in Draw 1. Receipts received at the Fiscal Receipts Lottery Unit by not later than noon of the 10th day of the month shall be drawn in Draw 2, as indicated in paragraph (c).

(e) The prize fund shall be EUR 60,000 for each draw taking place every month, or any other amount which the Minister responsible for Finance may establish from time to time.

(f) The draws of the winning receipts shall be carried out from an urn located at the Fiscal Receipts Lottery Unit.

(g) In each draw a win shall be determined by the drawn receipt being declared valid and, afterwards, the value of the receipt, namely the total final amount payable, shall be multiplied by one hundred (x 100). In this respect, a receipt having a value of EUR 23.29 shall be multiplied by one hundred (x 100) and the prize will be EUR 2,329.

(h) Where a receipt includes items that fall under the Beverage Container Refund Scheme (BCRS), the value of the receipt (i.e. the total final amount payable) on which a win shall be determined, shall be the amount excluding any BCRS refundable deposits but including any amounts paid by way of redemption of BCRS deposit vouchers, as the case may be.

(i) Each winning receipt shall entitle the winner to a minimum prize of EUR 233, while the maximum entitlement shall be limited to EUR 11,647. In this respect, receipts with a value of up to EUR 2.33 shall entitle the winner to a prize of EUR 233 but a winning receipt with a value of EUR 139.76 shall entitle the winner to a prize of only EUR 11,647 and not EUR 13,976.

(j) For each of the two draws, receipts will continue to be drawn until the total prize fund of EUR 60,000 is reached. The last valid receipt drawn before the maximum total of EUR 60,000 allocated to the prize fund is reached shall be honoured even if, through the drawing of this last receipt, the allocated sum of EUR 60,000 is surpassed.

(k) Undrawn receipts shall be destroyed within a reasonable time from the date of each draw.

(l) The draws shall be carried out under the supervision of a Board composed of the following:

Members:

(i) a representative from the Ministry responsible for Finance;

(ii) a notary from the Office of the Notary to Government;

(iii) a representative familiar with VAT legislation from the Office of the Commissioner for Tax and Customs.

Observers:

(i) a representative appointed from among the general public by the Minister responsible for Finance; and

5.  At the beginning of each month, and in any case not later than noon of the tenth (10) day of that month, the participants should post or deliver the receipt they wish to submit for the draw to the Fiscal Receipts Lottery Unit.
