The Office for Competition (the Office) within the Malta Competition and Consumer Affairs Authority enforces the merger control regulations. Merger control rules came into force in 2003. The merger control regime in Malta is currently governed by the Control of Concentrations (SL 379.08). Merger control is important to prevent harmful concentrations of market power that could result in substantial lessening of competition, harm consumers, or stifle innovation.


Although some minor amendments have taken place since 2007 however no significant amendments have taken place since then, effectively maintaining the merger control regulations unchanged for more than 20 years. The aim of these amendments is to modernise and simplify Maltese merger control, enhance legal certainty and improve several key aspects of the merger control regime.
