The Office for Consumer Affairs (OCA) within the Malta Competition and Consumer Affairs Authority (MCCAA) is launching this public consultation in relation to the proposed Consumer Credit Regulations, 2026, which will transpose Directive (EU) 2023/2225 on credit agreements for consumers (CCD II) into Maltese law. For the purposes of this consultation, the scope of CCD II applies to traders offering credit facilities, while credit institutions and other licensed entities fall within the supervisory remit of the Malta Financial Services Authority (MFSA); accordingly, the proposals set out herein apply solely to traders offering credit facilities.
The objective of this consultation is to seek the views of stakeholders and the general public on how Malta should exercise certain discretionary options permitted under the CCD II. These national choices will shape the final regulatory framework applicable in Malta.
This consultation focuses exclusively on those areas where Member States are afforded discretion. Provisions of the Directive that are mandatory and leave no scope for national variation are not subject to consultation.
Feedback received through this consultation will be reviewed and considered prior to the finalisation and adoption of the Consumer Credit Regulations, 2026.
