MINISTRY FOR ENERGY AND HEALTH
Registration of Solar Water Heaters, Solar Collectors and Photovoltaic Systems - Amendment to the Scheme
IN accordance with section 5, (Amendments and duration of Government Notice) of Government Notice 52 published in the Government Gazette dated 15th January, 2010, the Malta Resources Authority is making the following amendments to the Scheme.
1. (a) In Section 1 of the Scheme the definition of ‘third party certificate’ shall be substituted by the following:
‘third party certificate’ means a final report from a third party certifying body which states that equipment or systems are in accordance with the standards required by this Government Notice. The certificate shall
be valid at the time of registration and shall have an expiry date. In the case where a certificate does not have an expiry date, the modules will be listed for expiry 3 years from the date of issue of the certificate.
Such a certificate will only be considered if it is:
(i) an original; or
(ii) confirmed as a true copy of the original by the third party certifying body; or
(iii) publically available in the website of the third party certifying body.
(b) In Section 1 of the Scheme the definition of ‘third party certification by certified bodies’ shall be substituted by the following:
‘third party certification’ means certification from third party certifying bodies which through necessary verifications and assessments carried out, issue third party certificates with regard to eligible equipment after this has passed tests carried out by a third party test laboratory;
(c) In Section 1 of the Scheme the definition of ‘third party test laboratory’ shall be substituted by the following:
‘third party test laboratory’ means an independent accredited organization which is accredited for the applicable testing by the Malta Standards Authority or an equivalent organisation (i.e. Accreditation bodies which are members of the European co-operation for Accreditation (EA) or International Accreditation Forum (IAF) Multilateral Recognition Agreement (MLA) are considered as equivalent to MSA) that performs tests under certain controlled conditions which are made to demonstrate compliance with EU technical standards;
2. (a) A new paragraph (viii) shall be inserted in Section 2 as follows:
(viii) Installations shall be carried out by installers certified in accordance with Government Notice 404 of the 14th May, 2013 for the installation of the relevant technology. Retailers shall notify the Authority of the installers and engineers with whom they have a contractual relationship. Retailers shall be registered if they have a contractual relationship with:
At least one warranted electrical engineer who can certify installations of PV systems; and
At least one installer certified in accordance with Government Notice 404 of the 14th May, 2013 for the installation of the relevant technology:
This clause shall apply for PV installations as from 1 June, 2015 and to other system installations as from 1 June, 2016. Retailers who do not have such contractual relationships can be registered provisionally for a period of 6 months.
(b) The words ‘provisionally’ and ‘provisional’ shall be deleted in paragraph (v) of Section 2. The following sentences shall be added at the end of paragraph (v) of Section 2:
The retailer shall have the responsibility to behave in a competent, professional and honest manner. The Authority may withdraw or suspend registration in cases of improprieties, including financial malpractice or suspected fraud; improper conduct or unethical behavior; failure to comply with legislation or scheme conditions; danger to health, safety or the environment; criminal activity by the retailer or his/her employees within the ambit of the scheme; or attempts to abet or conceal any of these actions or attempt to induce others to facilitate such actions.
3. (a) Paragraph ii of Section 3 shall be replaced by the following:
“The systems or equipment shall be registered by the Authority when certified as compliant with MSA EN standards as specified in this Government Notice, for the duration of validity of the third party certificate. The Authority shall register eligible systems or equipment in one of the lists of eligible technologies. The full content of the applicable EN standards can be made available for viewing at the Malta Standards Authority.”
(b) In paragraph iii of Section 3, the words “Certified true copies of third party certification by certifying bodies” shall be substituted by the words “Third party certificates”;
(c) Paragraph iii (a) of Section 3 shall be substituted by the following:
PV Module Models shall be certified by the third party certifying body as compliant with MSA EN 61215 or MSA EN61646 or an equivalent thereof when so considered by the Malta Standards Authority.
Inverters shall be accompanied by a letter from the distribution system operator (Enemalta plc) stating that the inverter model meets the certification, testing and connection requirements as specified in the network code. Until such time that the network code includes such provisions, the following shall apply:
as from 1st May, 2015, inverters shall be provisionally registered if they are certified by the third party certifying body as compliant with MSA EN 50438 or an equivalent thereof when so considered by the Malta Standards Authority. G83/2 certification will be considered as equivalent to EN50438. In the case of inverters that do not fall within the scope of MSA EN 50438, G59/3 certification by a third party certifying body shall be accepted.
Inverters registered as part of PV systems with the Authority up to the 30th April, 2015 shall continue to be such registered until the 31st December, 2015, following which new registration shall be required;
(d) Paragraph (d) of Section 3 iii shall be deleted.
(e) In paragraph iv of Section 3, the words “Where testing has been carried out by an independent certifying body or third party test laboratory, which is accredited for the applicable testing by the Malta Standards Authority or an equivalent organisation, a report prepared and issued by such laboratory shall be provided to the Authority, which report shall contain the results of the testing carried out. Such testing report shall:” shall be substituted by the words: “The Authority may request a report of the results of the tests carried out on the equipment. Such testing report shall:”
(f) Paragraph vii of Section 3 shall be substituted by the following:
“Proof of compliance with the standards required to be complied with by this Government Notice shall be made through the submission of third party certificates.”
4. The Schedule shall be substituted by the following two schedules on pages from 8959 to 8965:
5. This Government Notice has been notified in terms of Directive 98/34/EC, as amended by Directive 98/48/EC, as transposed by the Notification Procedure Regulations.
