By means of a decree given by this Court on the 14th June, 2018, following a request by Albert Bonnici it was ordered that deputy curators be chosen to represent the absent Catalina Maria Rios Barberi, in the Divorce Application 295/18AL in the names Albert Bonnici vs Deputy Curators and in all other relative and subsequent acts.

By means of a Divorce application, filed in the Civil Court (Family Section), in the names Albert Bonnici (ID 197572M) vs deputy curators to represent the absent Catalina Maria Rios Barberi holding Columbian identity card number 43625669, on 13th June, 2018, the applicant Albert Bonnici (ID 197572M) requested and confirmed on oath that:

The applicant married the respondent Catalina Maria Rios Barberi holding Columbian identity card number 43625669 on the 20th September, 2009;

By means of a contract dated 16th September, 2009, the applicants excluded the community of acquests regime such that during their marriage they were regulated by the separation of estates.

From this marriage no children were born;

The matrimonial life between the applicant and the respondent was no longer possible and they had been separated de facto from the beginning of the 2013 and consequently they have been separated de facto from more than four years in these last five years;

The applicant and the respondent has total separate lives from each other and consequently there is no reasonable prospect for reconciliation between them;

The applicant wishes to proceed to obtain a divorce;

The respondent Catalina Maria Rios Barberi resides in Columbia whilst the applicant Albert Bonnici resides in Malta;

There is no common property between them and there is no need for the liquidation and division of that acquired;

The facts above mentioned satisfies the conditions needed to obtain a divorce in terms of Article 66B of the Civil Code, Cap. 16 of the Laws of Malta;

By means of a decree dated 21st May, 2018, the mediation was declared closed and the applicant was authorised to file the present application;

Thus, the applicant humbly requests this Honourable Court to:

1. Pronounce the dissolution of the marriage between the applicant and the respondent;

2. Order the Registrar of the Court so that within the time given by the Court, he notifies the Director of Public Registry of the dissolution of the marriage of the applicant such that this is registered at the Public Registry.

Save for any other order that this Honourable Court deems fit to order.

The applicant company is the owner of the hotel with the name Bayview Hotel, number 143, in Triq ix-Xatt, usually known as The Strand, Gżira, Malta;

The hotel above mentioned is built on the premises number 10 in Triq Samuel Taylor Coleridge, Gzira and this amongst other premises on which the same hotel is built;

The applicant acquired the premises number 10 in Triq Samuel Taylor Coleridge by means of a deed of sale in the records of Notary Doctor Maurice Gambin dated 27th September, 1994, a copy of which is here attached and marked as Doc. CS1;

The premises is subject to the annual and perpectual groundrent and sub-groundrent of Lm3.50 equivalent to €8.15 and payable to the respondents as follows:
a) The sum of €4.66 payable to the Testaferrata Morni Viani family;

b) The sum of €3.49 payable to Vincenzo and Alberto brothers Griscti;

The premises above mentioned is better described on the site-plan here attached and marked as Doc. CS2. For all intents and purposes, a copy of the notice of amalgamation between the companies Easybuy Limited (C 16670) and Carmelo Stivala Group Limited (C 62625) and C. Stivala & Sons Limited (C 4510) and also the notice of amalgamation between the companies Carmelo Stivala Group Limited (C 62625) and C. The applicant company wish to avail itself of the option that Article 1501 of the Civil Code gives it and thus redeem the groundrent above mentioned;

The identity of the brothers Griscti is not known to the applicant company and so the sub-groundrent is not being paid;

Together with this schedule of deposit the applicant is filing an application for the appointment of deputy curators to represent the interest of the unknown direct owners;


The applicant company wishes to pay the amount of 5 years groundrent, and that is the sum of €40.75;

The groundrent of €8.15 capitalised at the rate of 5% amounts to €163;

Thus, the applicant company is calling upon this Honourable Court and under its authority is depositing the total amount of €203.75, which amount may be freely withdrawn by the respondents as follows:

The applicants wish to pay the last five years of ground rent and redeem the ground rent and this by availing themselves of the option that they have in terms of Article 1501 of the Civil Code;

The amount of €6.59 capitalised at the rate of 5% amounts to €131.80 whilst the arrears being amount to €32.95;

The amounts has to be divided as follows:

1. €48.25 to be paid to the inheritance of Rosa Falzon as for €38.60 as the price for the redemption of the groundrent and the balance as arrears;

2. €116.50 to be paid to the inheritance of Rita Bianco as for €93.20 as the price for the redemption of the groundrent and the balance as arrears.

Thus, the applicants are calling upon this Honourable Court and under its authority are depositing the total amount of €164.75 representing the redemption of ground rent and subgroundrent and the five years arrears of the same , which amount may be freely withdrawn by the respondents in the amount above mentioned after leaving the relative receipt according to law.

From these, Alfred Abela died first on the 2nd April, 2002, and left his heirs in England and namely his wife Fiorella Abela the respondent;

Subsequently, Rev. Anton Abela died on the 4th August, 2005, and he left his share of the said premises number 35, in Triq il-Ġdida, today Triq Robert Naudi in Msida, in his will in the acts of Notary Victor Bisazza, dated 11th January, 1989, to his sister Mary Abela;

Mary Abela died on the 19th June, 2014, and left her share from these premises to her siblings who were still alive and who that day were Francis, Carmelo sive Charles, Joseph, Emanuel, Concetta Dimech, Josephine Camilleri and Crocifissa Calvin;

Francis Abela died on the 14th August, 2014, and he left as his sole heir his wife Rita Abela who died on the 26th September, 2016, and left as heirs her five children Dr Thomas Abela, Josephine Cachia, Mary Rose Pool, Lorenza Abela Fazio and Tereża Zammit Marmara, applicants in this law suit with others;

So today the respondent Fiorella Abela is the owner of one tenth (1/10) from the said premises, the applicants today together are the owners of nine tenths (9/10) of the premises number 35, Triq Robert Naudi, Msida;


The applicants found the sale of the premises to third parties at a fair market price, so much so that a promise of sale was signed and a copy of which is attached as Doc. A, to Darren Pisani and AnnMarie Bonnici, as evidenced by Notary Joanne Spiteri;

Thus the applicants request with respect that this Honourable Court:

1. Authorises the sale of the premises number 35, in Triq Robert Naudi, Msida, and this in terms of Article 495A of Cap. 16 of the Laws of Malta and this according to the terms and conditions indicated in the promise of sale above mentioned of the 30th May, 2017, as extended on the 29th November, 2017, in the acts of Notary Joanne Spiteri;

By means of a decree of the 25th June, 2018, of the Rent Regulation Board, in the records of the Application in the names Janice Baldacchino vs Raymond Buhagiar, Application Number 53/2018FDP, the following publication was ordered for the purpose of effecting service on the respondent Raymond Buhagiar in terms of Article 187(3) et sequitur of the Code of Organisation and Civil Procedure (Cap. 12).

By means of an application in the names Janice Baldacchino (ID 482085M) vs Raymond Buhagiar (ID 134256M), filed in the Rent Regulation Board, on the 7th May, 2018, the applicant Janice Baldacchino requested with respect:

The respondent leases from the applicant the garages with number 44 and 35 in the second underground level (-2) forming part of the complex known as Sant’Agata Residential Complex, in Vjal l-Indipendenza, Żurrieq, and this under the terms and conditions agreed by means of a private writing dated 20th October, 2016. Copy of this private writing is attached as Doc. A.

Although the lease expired on the 19th October, 2017, without being extended, the respondent retained the garages to him leased without compensating the applicant for occupying the same garages;


Although the respondent was duly solicited to vacate from the garages in question and also to pay the compensation to the applicant for the occupation of the same garages after the termination of the lease period, the same respondent remained in default.
Accordingly, this application had to be made.

Thus, the applicant, humbly requests this Board to:


i) Declare and decide that the respondent does not have any title to occupy the garages with number 44 and 35 in the complex known as Sant’Agata Residential Complex, in Vjal l-Indipendenza, Żurrieq;

ii) Condemn the respondent to vacate from the garages with number 44 and 35 under the complex known as Sant’Agata Residential Complex, in Vjal l-Indipendenza, Żurrieq, and this within a short and peremptory period which shall be imposed on him;
